ORDINANCE NO. 2069 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING THE APPLICATION OF LYNN JANSEN OF LYNDEN HOMES <br /> FOR PUD DEVELOPMENT PLAN APPROVAL, AS FILED UNDER CASE PUD- <br /> 94 <br /> WHEREAS, Lynn Jansen of Lynden Homes, has applied for Planned Unit <br /> Development (PUD) development plan approval to construct a seven lot detached <br /> single-family home development on an approximately 3.7 acre site generally located <br /> north of the present terminus of Calico Lane and east of the present terminus of Lynn <br /> Drive; and <br /> WHEREAS, a Negative Declaration was prepared in conjunction with the <br /> rezoning of the property in 2011. The Negative Declaration analyzed the proposed <br /> seven lot development as a future development of the site. The Negative Declaration <br /> states that a separate Negative Declaration would be prepared if significant changes <br /> have occurred. The proposed PUD plan is consistent with the Negative Declaration <br /> previously prepared for the rezoning of the subject site and none of the conditions in <br /> CEQA Guidelines Section 15162 calling for the preparation of a subsequent negative <br /> declaration have occurred; and <br /> WHEREAS, at its meeting of May 21, 2013, the City Council received a report <br /> from the Director of Community Development, including the Planning Commission's <br /> positive recommendations for approval of the PUD development plan; and <br /> WHEREAS, the City Council held a public hearing on May 21, 2013, at which <br /> time the applicant and other members of the public were offered an opportunity to <br /> present information regarding this application; and <br /> WHEREAS, after a review of the materials presented, the City Council <br /> determines that the PUD plan is consistent with the General Plan and the purposes of <br /> the PUD ordinance based on the findings set forth in the report presented to the City <br /> Council on May 21, 2013, and information presented at the public hearing. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DOES HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. The City Council finds that the project is consistent with the <br /> Pleasanton General Plan and the PUD District ordinance of the City of Pleasanton, and <br /> that the project is consistent with the negative declaration prepared for the earlier <br /> rezoning of this site. <br />
