BACKGROUND On March 19, 2013, as part of the 2013 LPFD Weed Abatement Program, the City Council adopted Resolution No. 13-601, which declared that weeds on specified properties constituted a public nuisance, ordered the abatement thereof, and set a public hearing to hear objections to the proposed abatement. On April 16, 2013, the City Council adopted Resolution No. 13-607, which ordered the abatement of weeds on the parcels identified in Resolution No. 13-601 and declared that the weed abatement costs, including a 100% mark up charge for administrative costs, are the responsibility of the property owner. This agenda report is the third and final agenda report to the City Council regarding the 2013 Weed Abatement Program. After the City Council meeting on April 16, 2013, fire inspectors re-surveyed the parcels for compliance. A contractor hired by the City abated the weeds and reduced the hazard on parcels which were non compliant after the May 31, 2013 deadline. The Government Code provides that the abatement costs, including the administrative costs for enforcement, are recoverable and constitute a special assessment against the parcels that are abated. After the assessment is made, unless an exception applies, a lien attaches on the parcel upon recordation of the order confirming the assessment and the lien will be included on the property owner's regular tax bill for the parcel requiring abatement. Property owners have until July 16th at 5:00 pm to pay the invoice to avoid it being placed on their tax bill. An itemized report showing the cost of weed abatement on a lot-by-lot basis throughout the City is attached to the resolution that accompanies this agenda report. DISCUSSION At this hearing, after considering any and all objections to the proposed abatement, the City Council should overrule the objections to the proposed abatement and/or move to amend the list of properties abated.
