Canyons Parkway <br /> Livermore, CA 94551 <br /> Attention: Real Property Services <br /> NO RECORDING FEE REQUIRED(GOVT.CODE§27383) SPACE ABOVE THIS LINE FOR RECORDER'S USE <br /> LICENSE AGREEMENT FOR STORM DRAIN <br /> THIS LICENSE AGREEMENT (hereinafter"License"), is made and entered into this <br /> day of , 2013, by and between Zone 7 of Alameda County Flood Control and Water <br /> Conservation District, a body corporate and politic (hereinafter"Licensee") and the City of <br /> Pleasanton, a Municipal Corporation (hereinafter"Licensor"). <br /> RECITALS <br /> A. Licensor does hereby grant unto Licensee a non-exclusive license to reconstruct, replace, use, <br /> inspect, maintain, repair, operate or remove a Storm Drain, including any and all <br /> appurtenances thereto, under, over, and across all that certain real property in the City of <br /> Pleasanton, County of Alameda, State of California, described and depicted in attached <br /> Exhibit"A", attached hereto and incorporated herein by reference ("License Area"). <br /> B. Licensor has street right of way in the License Area, known as Mohr Avenue(10 foot wide), <br /> and desires to grant a license to Licensee for the purpose of allowing Licensee to reconstruct, <br /> operate, maintain, repair or replace a Storm Drain system, and appurtenances thereto, upon <br /> the aforesaid License Area which shall be the sole responsibility of Licensee. <br /> NOW, THEREFORE, BE IT MUTUALLY AGREED as follows: <br /> 1. This License shall not require payment of any rent to Licensor for the use of the License <br /> Area for the purposes for which it is permitted. <br /> 2. The term of this License shall be for twenty-five (25) years from the date of execution of <br /> this License with an option by Licensee to renew for additional periods of twenty-five <br /> (25) years upon written notice to Licensor. Licensee's obligations under Sections 3 (re <br /> Indemnification) shall survive the termination of this License. <br /> 3. Licensee agrees to indemnify and hold harmless Licensor from and against all claims, <br /> demands, suits, costs, expenses, liabilities, fines, penalties, losses, damages and injury to <br /> person, property or otherwise, including, without limitation, direct, indirect and <br /> consequential damages, court costs and reasonable attorney's fees, arising from or in any <br /> respect related to any exercise of or use of the License by the Licensee or its agents <br /> 1 <br />
