CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 856 <br /> <br /> AN ORDINANCE DELETING SUBSECTION (c)OF §1-6.65 (EXCEPTIONS), <br /> OF ARTICLE 6, CHAPTER 3, TITLE I OF THE ORDINANCE CODE, AND <br /> AMENDING §2-4.31 (DWELLING UNITS NOT PART OF SUBDIVISION) <br /> OF ARTICLE 10 (DEDICATION OF PUBLIC PARK LAND, PAYmeNT OF <br /> FEES, OR A COMBINATION THEREOF), CHAPTER 1 (SUBDIVISIONS) OF <br /> TITLE II (ZONING AND DEVELOPMENT) OF THE ORDINANCE CODE OF <br /> THE CITY OF PLEASANTON <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1. Subsection (c) of §1-6.65, of Article 6, Chapter 3, Title I <br />of the Ordinance Code of the City of Pleasanton is hereby deleted in <br />its entirety. <br /> <br /> Section 2. Section 2-4.31 of Article 10, Chapter 1, Title II of <br />the Ordinance Code of-the City of Pleasanton is amended in its entirety <br />to read as follows: <br /> <br /> §2-4.31 New Residential Construction; Credit for Previously <br /> Paid Fees or Dedications. An applicant for a permit to <br /> construct a residential dwelling unit (including but not <br /> limited to a single family unit, a unit in a multi-family <br /> project or a mobile home lot), shall dedicate land, pay <br /> a fee in lieu thereof, or a combination of the two for <br /> park and recreational facilities in accordance with the <br /> standards established by this chapter and the Resolution <br /> Establishing Fees and Charges for Various Municipal Ser- <br /> vices. If a park fee was paid or land dedicated for the <br /> parcel on which the residential construction is to take <br /> place, the City shall credit such payment or dedication <br /> against the fees or dedications required by this chapter <br /> and the fees and charges resolution <br /> <br /> This section is required to insure that all residential <br /> dwelling units pay their share of the park and recreation <br /> land and facility burden generated by their construction <br /> and thus protect and promote the health and general wel- <br /> fare of the residents of the City and to provide that <br /> construction on newly subdivided land and previously <br /> divided land share such costs equally. <br /> <br />Section 3. This Ordinance shall be come effective thirty (30) days <br />after its adoption. <br /> <br />Section 4. This Ordinance shall be published once within fifteen (15) <br /> days after its adoption in the "TIMES," a newspaper of general <br /> circulation published and circulated in the City of Pleasanton. <br /> <br />INTRODUCED at a regular meeting of the City Council of the City of <br />Pleasanton on June 20, 1978. <br /> <br /> <br />
