ORDINANCE NO. 2072 <br /> AN ORDINANCE APPROVING AN APPLICATION FOR A PLANNED UNIT <br /> DEVELOPMENT (PUD) MAJOR MODIFICATION TO THE APPROVED <br /> PUD (PUD-84-04) GOVERNING THE MEADOW PLAZA SHOPPING <br /> CENTER ON SANTA RITA ROAD TO ALLOW MASSAGE <br /> ESTABLISHMENTS WHERE THREE OR FEWER MASSAGE <br /> TECHNICIANS PROVIDE MASSAGE SERVICES AT ANY ONE TIME AS <br /> A PERMITTED USE AND MASSAGE ESTABLISHMENTS WHERE <br /> FOUR OR MORE MASSAGE TECHNICIANS PROVIDE MASSAGE <br /> SERVICES AT ANY ONE TIME AS A CONDITIONALLY PERMITTED <br /> USE AS FILED UNDER CASE NO. PUD-84-04-07M <br /> WHEREAS, Tranquil Massage Center applied for a Planned Unit Development <br /> (PUD) minor modification to allow massage establishments where three or fewer <br /> massage technicians provide massage services at any one time as a permitted use and <br /> massage establishments where four or more massage technicians provide massage <br /> services at any one time as a conditionally permitted use within Meadow Plaza <br /> Shopping Center at 3112, 3120 and 3128 Santa Rita Road; and <br /> WHEREAS, the City received an from a member of the public and therefore the <br /> application become a major modification; and <br /> WHEREAS, at its meeting of May 8, 2012, the Planning Cormission held a <br /> noticed public hearing and considered all public testimony, relevant exhibits, and <br /> recommendations of City staff concerning the application, and recommended approval <br /> of the PUD major modification; and <br /> WHEREAS, a duly noticed public hearing was held on June 4, 2013, where the <br /> City Council received a report from the Director of Community Development, together <br /> with a copy of the staff report to the Planning Commission, regarding this application; <br /> and <br /> WHEREAS, at the public hearing on June 4, 2013, the applicant and other <br /> members of the public were offered an opportunity to present evidence regarding the <br /> application; and <br /> WHEREAS, at the public hearing on June 4, 2013, the City Council, after a <br /> review of the materials presented, approved the applicant's request to amend the list of <br /> uses for Meadow Plaza Shopping Center to allow massage establishments where three <br /> or fewer massage technicians provide massage services at any one time as a permitted <br /> use and massage establishments where four or more massage technicians provide <br /> massage services at any one time as a conditionally permitted use. <br />
