Mr. Bocian noted that staff received several questions today relative to St. Anton's bond application and <br /> its reference to an afterschool and education program. Staff has discussed this with the developer, who <br /> has indicated that they are proposing to provide those types of services but that the exact scope and <br /> nature of the programs will be geared towards actual tenants. <br /> Councilmember Brown asked what enforcement rights the City has relative to these programs. <br /> Mr. Bocian explained that it is dependent upon where it is memorialized. In an agreement between St. <br /> Anton Partners and the issuer of the bonds, the City has no responsibility or authority. If, however, the <br /> intent were to be memorialized in any of the City's documents or agreements then the City would have <br /> some amount of oversight. He explained that the agreements and responsibilities addressed through <br /> the bond and tax credit process may prove sufficient or the Council can explore the possibility of adding <br /> language to the project's development agreement. <br /> Mayor Thorne opened the public hearing. <br /> Carmen Rivera-Hendrickson said she has not uncovered any obvious issues with the project but would <br /> like to see an ADA evaluation and be allowed to review the plans to ensure that universal design is <br /> properly addressed. <br /> Mayor Thorne closed the public hearing. <br /> MOTION: It was m/s by Brown/Narum to waive full reading and adopt Resolution No. 13-622 <br /> approving the issuance of Multifamily Housing Revenue Obligations in the anticipated principal amount <br /> of $40,000,000 for the purpose of financing the acquisition and construction of the 168-unit multifamily <br /> residential rental facility, Anton Hacienda Apartments, to be located at 5729 West Las Positas <br /> Boulevard. PUD-81-30-87D, St. Anton Partners, Inc.; Anton Hacienda Apartments - Consider applications <br /> for (1) PUD Development Plan approval to construct 168 apartment units and related site <br /> improvements at 5729 West Las Positas Boulevard; (2) an Affordable Housing Agreement; (3) <br /> Inclusionary Unit Credit Agreement and (4) Growth Management agreement <br /> Planning Manager Stern presented the staff report which she said relates to an application by St. Anton <br /> Partners to construct 168 apartment units and related site improvements on West Las Positas <br /> Boulevard within Hacienda Business Park. <br /> She presented several slides showing site orientation. The overall site plan includes two three-story <br /> buildings each containing 38 units facing West Las Positas and one four-story building with 92 units <br /> situated to the rear of the site. Site amenities include a community room, pool, pocket park, fenced pet <br /> area, clubhouse, fitness center, outdoor kitchen, additional green spaces and a connection to Tassajara <br /> Creek. In total, the project contains approximately 26,600 square feet of public open space, 4,200 <br /> square feet in private balcony areas and 10,000 square feet in patio areas. This meets the City's <br /> requirements of 300 square feet of outdoor usable space per unit. The project architecture is a mission <br /> hacienda design which is designed to complement neighboring residential development. <br /> Councilmember Brown asked Ms. Stern to discuss the existing retention pond on the site. <br /> Ms. Stern confirmed that a portion of the green space acts as a retention pond during inclement <br /> weather but said it is fully usable as open space approximately 90% of the time. <br /> City Council Minutes Page 4 of 14 May 21, 2013 <br />
