NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DOES HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. Approves Case PUD-81-30-87D, the application of St Anton <br /> Partners LLC for a PUD development plan to construct 168 apartment units, and related <br /> site improvements at the property, subject to the conditions as shown in Exhibit A, <br /> attached hereto and made part of this ordinance by this reference. <br /> SECTION 2. A summary of this ordinance shall be published once within 15 <br /> days after its adoption in the "Valley Times", a newspaper of general circulation <br /> published in the City of Pleasanton, and the complete ordinance shall be posted for 15 <br /> days in the City Clerk's Office within 15 days after its adoption. <br /> SECTION 3. This ordinance shall be effective upon the later to occur of: (1) thirty <br /> (30) days after the date of its final passage and approval, and (2) execution of an <br /> agreement between Hacienda Pleasanton, L.P. and the Pleasanton Unified School <br /> District relating to payment of school fees for the project at 5729 West Las Positas <br /> Boulevard; provided, however, that this ordinance shall become effective no later than <br /> the date that the ordinance adopting the related Development Agreement for 5729 West <br /> Las Positas Boulevard between the City of Pleasanton and Hacienda Pleasanton, L.P. <br /> is effective, even if the events described in (1) and (2) above have not yet occurred. <br /> The foregoing Ordinance was introduced at a regular meeting of the City Council of <br /> the City of Pleasanton on May 21, 2013, by the following vote: <br /> Ayes: Councilmembers Brown, Cook-Kallio, Narum, Pentin, Mayor Thorne <br /> Noes: None <br /> Absent: None <br /> Abstain: None <br /> And adopted at a regular meeting of the City Council of the City of Pleasanton on <br /> , 2013, by the following vote: <br /> Ayes: <br /> Noes: <br /> Absent: <br /> Abstain: <br /> Jerry Thorne, Mayor <br /> ATTEST: <br /> Karen Diaz, City Clerk <br />
