demolition. A no-disturbance buffer of 100 feet shall be created around active bat <br /> roosts being used for maternity or hibernation purposes. Bat roosts initiated during <br /> construction are presumed to be unaffected, and no buffer is necessary. <br /> 31.No new grading or development shall be allowed within 20 feet of the edge of <br /> riparian vegetation or top of bank of Tassajara Creek, whichever is further from the <br /> creek centerline, as delineated by a qualified, City-approved biologist that shall be <br /> hired by the applicant/developer. Prior to issuance of a building or grading permit, <br /> the biologist shall certify in writing to the Director of Community Development that <br /> the project is in compliance with this condition. <br /> 32.In the event that paleontological resources are encountered during the course of <br /> development, all construction activity must temporarily cease in the affected area(s) <br /> until the uncovered fossils are properly assessed by a qualified paleontologist and <br /> subsequent recommendations for appropriate documentation and conservation are <br /> evaluated and approved by the City of Pleasanton. Excavation or disturbance may <br /> continue in other areas of the site that are not reasonably suspected to overlie <br /> adjacent or additional paleontological resources. These requirements shall be <br /> printed on the site, grading, and landscape plans where applicable to the <br /> satisfaction of the Director of Community Development. <br /> 33.In the event that human remains are discovered during grading or construction, <br /> work shall stop immediately. There shall be no disposition of such human remains, <br /> other than in accordance with the procedures and requirements set forth in <br /> California Health and Safety Code Section 7050.5 and Public Resources Section <br /> 5097.98. These code provisions require notification of the County Coroner and the <br /> Native American Heritage Commission, who in turn must notify the persons <br /> believed to be most likely descended from the deceased Native American for <br /> appropriate disposition of the remains. These requirements shall be printed on the <br /> site, grading, and landscape plans where applicable to the satisfaction of the <br /> Director of Community Development. <br /> 34.The applicant/developer shall implement construction best management practices <br /> to reduce construction noise, including: <br /> a) Locate stationary construction equipment as far from adjacent occupied <br /> buildings as possible. <br /> b) Select routes for movement of construction-related vehicles and equipment <br /> so that noise-sensitive areas, including residences and outdoor recreation <br /> areas, are avoided as much as possible.
