<br />OF CALIFORNIA, REPEALING ORDINANCE 309 AND ALL
<br />AMI~NIXMENTS THERETO AND ADOPTING ZONING REG-
<br />ULATIONS INCLUDING A ZO'NING MAP DESIGNATING
<br />DISTRICT BOUNDARIES AND REGULATIONS CONTROL-
<br />LING TI-rE USES OF LAND; THE DENSITY OF POPLUA-
<br />TION; THE BULK, LOCATION, AND USES OF STRUC-
<br />TURES; THE AREAS AND DIMENSIONS OF SITES; AND
<br />THE APPEARANCE OF CERTAIN USES, STRUCTURES, AND
<br />SIGNS; REQUIRING THE PROVISIONS OF USABLE OPEN
<br />
<br />SPACE, SCREENING AND LANDSCAPING, AND OI
<br />STREET PARKING AND OFF-STREET LOADING FACI
<br />TIES; CONTROLLING THE LOCATION, SIZE AND
<br />MINATION OF SIGNS; PROVIDING FOR THE AMENDMEJ
<br />OF THE DISTRICT BOUNDARIES AND THE REGU1
<br />TIONS; AND PROVIDING FOR THE ADMINISTRATI(
<br />AND ENFORCEMENT OF THE REGULATIONS.

<br />The City Council of the City of Pleasanten does hereby ordain
<br />follows:
<br />
<br />ARTICLE 1. General
<br />
<br /> Sec. 1.100. Reference.
<br /> This ordinance shall be known and cited as "The Zoning Ordinance
<br /> of the City of Pleasanton".
<br />
<br /> Sec. 1.I01. Ob.iectives.
<br /> The zoning ordinance is adopted to protect and to promote the pub-
<br /> lic health, safety, peace, comfort, convenience, prosperity, and
<br /> general welfare. More specifically, the zoning ordinance is adopted
<br /> in order to achieve the following objectives:
<br />
<br /> a. To provide a precise guide for the physical development of the
<br /> city in such a manner as to achieve progressively the arrange-
<br /> ment of land uses depicted in the General Plan adopted by the
<br /> City Council.
<br /> b. To foster a harmonious, convenient, workable relationship
<br /> among land .uses.
<br /> c. To promote the stability of existing land uses that conform with
<br /> the General Plan and to protect them from inharmonious influ-
<br /> ences and harmful intrusions.
<br /> d. To ensure that public and private lands ultimately are used for
<br /> the purposes which are most appropriate and most beneficial
<br /> from the standpoint of the city as a whole.
<br /> e. To prevent excessive population densities and overcrowding of
<br /> the land with structures.
<br /> f. To promote a safe, effective traffic circulation system.
<br /> g. To foster the provision of adequate off-street parking and off-
<br /> street truck-loading facilities.
<br /> h. To facilitate the appropriate location of community facilities
<br /> and institutions.
<br /> i. To promote commercial and industrial activities in erder to
<br /> strengthen the city's tax base.
<br /> j. To protect and enhance real property values.
<br /> k. To safeguard and enhance the appearance of the city.
<br />
<br /> Sec. 1.102. Nature of the Zoning Ordinance.
<br />This ordinance shall consist of a zoning map ~lesignating certain
<br />districts and a set of reguiatlons controlling the uses of land; the
<br />density of population; the bulk, locations, and uses of structures;
<br />the areas and dimensions of sites; the appearance of certain uses,
<br />structures, anal signs; requiring prov~sion of usable open space,
<br />screening and landscaping, and off-street parking and off-street
<br />loading facilities; and controlling the location, size, and illumination
<br />of signs. The zoning map shall be maintained on file in the office
<br />of the Zoning Administrator.
<br />
<br />Sec. 1.103. Interpretation.
<br />In their interpretation and application, the provisions of this ordi-
<br />nance shall be held to be minimum requirements. No provision of
<br />this ordinauce is intended to repeal, abrogate, annul, impair, or
<br />interfere with any existing ordinance of the City oI Pleasanton, ex-
<br />cept as is specifically repealed herein, provided that where this
<br />ordinance imposes a greater restriction on the use et land or struc-
<br />tures or the height or bulk of structures, or requires greater open
<br />spaces about structures, or greater areas or dimensions of sites, or
<br />greater restrictions on signs, than is imposed or required by an ex~
<br />isting ordinance, this ordinance shall control.
<br />This ordinance is not intended to abrogate, annul, impair, or in-
<br />terfere with any deed restriction, covenant, easement, or other
<br />agreement between parties, provided that where this ordinance
<br />imposes a greater restriction on the use of land or structures or
<br />the height or bulk of structures, or requires greater open spaces
<br />about structures or greater areas or dimensions of sites than is
<br />imposed or required by deed restriction, covenant, easement, or
<br />other agreement, this ordinance shall control.
<br />
<br /> Sec. 1.104. -~)plication.
<br />This Ordinance shall apply to all property, except public streets a~
<br />alleys, owned by private persons, firms, corporations, or organi:
<br />tions; by the United States of America or any of its agencies; by t]
<br />State of California or any of its agencies or political subdivisior
<br />by any City or County including the City of Pleasanto~ or any of i
<br />agencies; or by any authority or ~tistrict organized under the laws
<br />the state of Califoruia. This Ordinance shall apply to structures a~
<br />signs extending into or above streets or alleys, to railroad rights-(
<br />way, to electric and communications distribution and service wit
<br />where prescribed in the ~listrict regulations; provided, however, th
<br />the routes of proposed electric or gas transmission lines shaII be su
<br />mitred to the Planning Commissien for approval prior to the acqx
<br />sition of right-of-way thereof. Upon review of the utility company
<br />application and the Planning Directer's proposed conditions f,
<br />route approval, the Planning Commission may set a public hearts
<br />for purposes of considering alternate routes, or modifying any co
<br />ditions vital to the public interest, which in the opinion of the pla
<br />ning Commission requires a public hearing.
<br />
<br />Sec. 1.105. Definitions.
<br />For the purposes of this ordinance, certain words and terms use
<br />herein are defined as follows:
<br />
<br />1.105.1.
<br /> a. The word "City" shall mea.n the City of Pleasanton, Alamed
<br /> County, California. The words "City Council" and "Council
<br /> shall mean the City Council of the City of Pleasanton. T~
<br /> words "City Planning .Commission", "Planning Commission", an
<br /> the "Commission" shall mean the Planning Commission. dui
<br /> appointed by the City Council. The words "Board of Adjns
<br /> ment" shall mean a committee of the City Planning Commissio
<br /> established as prescribed in Article 25, (Variances), and th
<br /> words "Board of Design Review" shall mean a committee of th
<br /> City Planning Commission established as prescribed in Articl
<br /> 18, (Design Review).
<br /> b. The words "City Clerk" shall mean the City Clerk of the Cit
<br /> of Pleasanton, and the word "Secretary" shall mean the Secr~
<br /> tary of the City Planning Commission, Board of Adjnstmen~
<br /> and Board of Design Review. The weeds "l~uildlng Inspector
<br /> shall mean the Building Inspector of the City of Pleasanton, th
<br /> words "Director of Public Works" shall mean the Director o
<br /> Public Works of the City of Pleasanton, the words "Zonin~
<br /> Administrater" shall mean the Zoning Administrator of the Cit:
<br /> of Pleasanton or his deputy designated by the City 'Manager o
<br /> the City of Pleasanter, the words "City Attorney" shall meal
<br /> the City Attorney of the City of Pleasanton, and the word
<br /> "Chief of Police" shall mean tbe Chief of Police of the Cit'.

<br />1.105.2.
<br /> a. Access corridor. A portion of the site providing access from ~
<br /> street and having a minimum dimension less than the require(
<br /> site width, except that no portion of a site having side lot line:
<br /> ra~lial to the center of curvature of a street from the street prop
<br /> erty line to the rear lot line shall be deemd an access corridor
<br /> The area ef an access corridor shall not be included in determin
<br /> lng the area of a site.
<br /> b. Alley. A public way permanently reserved primarily for vehi
<br /> cular service access to the rear or side ef properties otherwis~
<br /> abutting on a street.
<br /> c. Alter. To make a change in the supporting members of a strue
<br /> ture, such as bearing walls, columns, beams, or girders, whicf
<br /> will prolong the life of the structure.
