ARTI!CLE 12. RO Residential Overlay District.

<br /> See. 12.100. Purposes.
<br /> In addition to the objectives prescribed in Sec. 1.10I, (Objectives),
<br /> the RO residential overlay district is included in the zoning ordi-
<br /> nance to achieve the following purposes:
<br /> a. To establish controls in addition to those established in Arti-
<br /> cles 2, 4 and 5 in order to direct the .development of large par-
<br /> cels of land in conformance with the resldential development
<br /> policies as set forth in the General Plan adopted by the City
<br /> Council.
<br /> b. To ensure variety and a mixture of housing types, densities and
<br /> lot sizes in large developments.
<br />
<br /> Sec. 12.101. Initiation.
<br /> An amendment to recIassify property to an RO district may be ini-
<br /> liated by the owner, the City Planuing Commission, or the City
<br /> Council It is the intent of this section, that the Commission shall
<br /> initiate RO districts in predominately undeveloped areas where the
<br /> application of the requirements of this article would contribute to-
<br /> ward achievement of the objectives prescribed in Sec. 1.101, (Ob-
<br /> jectives), and the purposes prescribed in Sec. 12.100 (Purposes).

<br /> See. 12.162. Applicability.
<br /> a. The RO district shall be established only in conjunction with
<br /> other districts, but shall hot be combined with a PUD district.
<br /> An RO ~listrict shall overlay whatever other district designa-
<br /> tion is applicable to the area in which the RO district is
<br /> established.
<br /> b. The provisions of this article shall apply in RO districts, which
<br /> districts shall also be subject to other provisions of this ordi-
<br /> nance including the provisions applicable to the particular dis-
<br /> trict underlying an RO district provided that where regulations
<br /> conflict, the provisions of this article shall control.
<br /> c. An application to amend the ordinance so as to change dis-
<br /> trict boun'daries underlying a~n RO district shall not be con-
<br /> strued as a request to change the boundaries of the RO dis-
<br /> trict unless such change is specifically requested in the appli-
<br /> cation.
<br /> d. The requirements of the RO district shall not apply to devel-
<br /> oped residential lots, to property included in a recorded final
<br /> subdivision map or vali.d approved tentative subdivision map,
<br /> or to annexed territory in which the development pattern has
<br /> been specifically committed by an annexation agreement. The
<br /> requirements of the RO district shall apply to property includ-
<br /> ed in an expired tentative subdivision map. Parcels less than
<br /> five acres on the effective date of this ordinance may be ex-
<br /> empted from the requirements of the RO district, provide.d that
<br /> the Planning Commission shall find that the exemption will
<br /> not be detrimental to achievement of the purposes of this
<br /> article.

<br />Sec. 12.103. Lot Size Reguiatinns and Average Density.
<br />Where subdivision and initial developmeui of land after the effec-
<br />tive date of this ordinance is proposed, the following lot size yard
<br />requirements an.d density controls shall apply in addition to those
<br />of the underlying district.

<br />Section 12.103a, Limitation of RO Requirements
<br />
<br />The increased requirements set by the RO District in Section 12.1~
<br />above shall have no further force or effect upon an individual re:
<br />dential lot after construction and actual occupancy of the sing
<br />family dwelling.
<br />
<br />Sec. 12.104. Permitted Average Density.
<br />Within the limitations of minimum iot size of the underlying zoniz
<br />and the average lot size established by Sec. 12. 103, the averal
<br />gross residential density established by Sec. 12.103 for the particul~
<br />underlying Basic Zoning may be achieved by the establishment ,
<br />small RM districts unless the Planning Commission finds that sm
<br />districts in a particular area would be detrimental to the order
<br />development of the area and inconsistent with the purposes in Se
<br />12.100.

<br />Sec. 12.105. Size and Location of RM Districts.
<br />RM districts should be located throughout the residential area (
<br />thoroughfares or collector streets, and should be used as transition
<br />development between neighborhood commercial areas and R-1 re~,
<br />dential areas. RM districts within a tract that are not used as trane,
<br />tional development shall not be larger than three acres per distri,
<br />and separation of districts shall be 300 feet or more. An RM distri,
<br />used as a transitional development shall not exceed six acres, rd
<br />districts surrounded by R-1 districts shall be RM-4,000 or RM-2,50
<br />RM districts used as transitional development shall be RM-4,0O
<br />RM-2,500, or RM-2,000.

<br />Sec. 12.106. Area Plan Requirement.
<br />In ad'dition to the requirements established by Article 27 wher~
<br />ever an RO district is established, any subsequent application 5(
<br />change of the underlying zoning shall be accompanied by an are
<br />plan submitted for Planning Commission approval in conjunctio
<br />with the rezoning request. Such area plan shall include lot pattern
<br />street systems, location and size of RM districts, and density calc~
<br />Iations to clearly demonstrate that the average gross residenti~
<br />densities prescribe.d in Sec. 12.103 have not been exceeded.
