writing, regarding persons newly hired by the City into a PCEA/AFSCME <br /> LOCAL 955 represented classification, to the designated Union Official within <br /> seven (7) workdays of the employees' official date of hire. <br /> c. Union Dues, and Service Fee, or Optimal Union Contribution Deduction <br /> Checkoff: <br /> 1. During the period PCEA/AFSCME LOCAL 955 remains the exclusive <br /> representative of the bargaining units listed in Appendix B and to the extent the <br /> laws of the State of California permit and as provided in this Section, the City will <br /> deduct one month's current and periodic Union dues or service charge based upon <br /> a uniform dues schedule from the pay of each employee who has executed and <br /> delivered to the City a deduction authorization form or who has deductions made <br /> from salary pursuant to Section b.2. <br /> 2. Payroll deductions shall be made only from the pay due employees on the first <br /> payday of each calendar month; provided, however, the initial deduction for any <br /> employee shall not begin unless both (I) a properly executed "Payroll Deduction <br /> Authorization for Membership Dues or Service Charge", and (2) the amount of <br /> the monthly membership dues or service charge certified by the President of the <br /> Union have been delivered to the City at least thirty (30) calendar days prior to <br /> the first payday of the calendar month. If the employee fails to properly execute <br /> the "Payroll Deduction Authorization for Membership Dues or Service Charge" <br /> within thirty (30) calendar days of hire into a classification covered by this MOU, <br /> the City will deduct the monthly membership dues or service charge <br /> automatically. Changes in the amount of the monthly membership dues or service <br /> charge also must be delivered to the City at least thirty (30) calendar days prior to <br /> the first payday of the calendar month before the change will become effective. <br /> 3. All sums deducted by the City shall be remitted to the Union at an address <br /> given to the City by the Union, once each month by the fifteenth (15°i) calendar <br /> day following the payday on which the deductions were made, together with a list <br /> of names, mailing addresses and the amount deducted for each employee for <br /> whom a deduction was made. <br /> 4. The Union may request the City to provide an optional voluntary Union <br /> deduction for members or service fee payers of the Union. Such deduction shall <br /> be requested by the member or service fee payer in even dollar amounts. The <br /> optional Union deduction shall be made only from the pay due to employees on <br /> the first payday of each calendar month. The member or service fee payer may <br /> discontinue the optional Union deduction at any time. Such request for optional <br /> Union deduction shall be made on "Payroll Deduction Authorization for Optional <br /> Union Contribution, PCEA/AFSCME LOCAL 955". The Union and City agree <br /> that such optional Union deduction is not subject to the provisions of the agency <br /> shop agreement between the Union and City. The Union agrees to refund to the <br /> City any amounts paid to it in error. <br /> -7 - <br />
