MEMORANDUM OF UNDERSTANDING <br /> Pleasanton City Employees Association, AFSCME, Local 955, AFL-CIO, and representatives of <br /> the City of Pleasanton, have met and conferred in good faith regarding wages, hours and other <br /> terms and conditions of employment of employees in the representation unit specified in Section <br /> I, have exchanged freely information, opinions and proposals and have endeavored to reach <br /> agreement on all matters relating to the employment conditions and employer-employee relations <br /> of such employees. <br /> This Memorandum of Understanding is entered into pursuant to the Meyers-Milias-Brown Act <br /> (Government Code Section 3500, et seq.) and has been jointly prepared by the parties. <br /> This Memorandum of Understanding shall be presented to the City Council as the joint <br /> recommendations of the undersigned for salary and employee benefit adjustments for the period <br /> commencing April 1, 2013 and ending March 31, 2016. <br /> Section 1. Recognition <br /> Pleasanton City Employees Association, AFSCME, Local 955, AFL-CIO, hereinafter <br /> referred to as the "PCEA/AFSCME LOCAL 955," the Union, is the formally recognized <br /> employee organization for the general employees unit comprised of the classifications <br /> listed in the attached salary schedule and certified pursuant to the Employer-Employee <br /> Relations procedures and Resolution No. 71- 75, adopted by the City of Pleasanton City <br /> Council on April 5, 1971. <br /> Section 2. Union Security/Agency Shop/Dues Deduction <br /> 2.1 Dues Deduction <br /> Upon receipt of a written assignment and authorization signed by the employee on the <br /> form shown below, the City agrees to deduct from every other paycheck of such <br /> employee an amount which will total the dues uniformly required for membership in the <br /> PCEA/AFSCME LOCAL 955. The amount so deducted shall be remitted by the City to <br /> the officer designated in writing by the President of the PCEA/AFSCME LOCAL 955 as <br /> the person authorized to receive such funds. <br /> The President of the PCEA/AFSCME LOCAL 955 shall notify the City Manager in <br /> writing as to the amount of such dues uniformly required of all members of the <br /> PCEA/AFSCME LOCAL 955. <br /> The employee's earnings must be regularly sufficient after other legal and required <br /> deductions are made to cover the amount of the dues check-off authorized. When an <br /> employee is in a non-pay status for an entire pay period, no withholding will be made to <br /> cover that pay period from future earnings. In the case of an employee who is in a non- <br /> pay status during only part of the pay period, and the salary is not sufficient to cover the <br /> full withholding, no deduction shall be made.
