ORDINANCE NO. 2067 <br /> AN ORDINANCE OF THE CITY OF PLEASANTON APPROVING THE <br /> APPLICATION OF PLEASANT PARTNERS, LLC FOR PLANNED UNIT <br /> DEVELOPMENT (PUD) MAJOR MODIFICATION AND DEVELOPMENT PLAN <br /> APPROVAL, AS FILED UNDER CASE PUD-85-08-1 D-4M <br /> WHEREAS, Pleasant Partners, LLC has applied for Planned Unit Development <br /> major modification and development plan approval to construct 305 apartment units, <br /> two retail buildings totaling approximately 7,520 sq. ft., new surface parking and a <br /> parking garage to serve the existing office uses, and related site improvements at the <br /> California Center property located at 4400-4460 Rosewood Drive ("the Project"); and <br /> WHEREAS, zoning for the property is Planned Unit Development— High Density <br /> Residential (PUD-HDR) and Planned Unit Development — Industrial/Commercial-Office <br /> (PUD-I/C-O) Districts; and <br /> WHEREAS, the Planning Commission adopted Resolution 2013-16, determining <br /> that the proposed major modification and development plan are appropriate for the site, <br /> making findings, and recommending to the Pleasanton City Council that PUD-85-08-1 D- <br /> 4M be approved; and <br /> WHEREAS, on April 16, 2013, the Pleasanton City Council held a duly noticed <br /> public hearing on this application and considered all public testimony, agenda reports, <br /> and related materials, and the recommendations of City staff and the Planning <br /> Commission; and <br /> WHEREAS, the City Council finds that the exceptions to the Housing Site <br /> Development Standards and Design Guidelines as stated on page 12 of the March 27, <br /> 2013, Planning Commission staff report are appropriate; and <br /> WHEREAS, the City Council determined that the conditions described in <br /> California Environmental Quality Act (CEQA) Guidelines Section 15162 have not <br /> occurred and found that the previously prepared Supplemental Environmental Impact <br /> Report (SEIR), including the adopted CEQA Findings and Statement of Overriding <br /> Considerations in City Council Resolution 12-492, and the Addendum to the SEIR for <br /> the Project are adequate to serve as the environmental documentation for the Project <br /> and satisfy all the requirements of CEQA; and <br /> WHEREAS, the Pleasanton City Council finds that the proposed PUD major <br /> modification and development plan are consistent with the City's General Plan and <br /> purposes of the PUD ordinance. <br />
