2.6 Advance Notice <br /> Except in cases of emergency as provided below in this subsection, the Union, if affected, <br /> shall be given reasonable advance written notice of any ordinance, resolution, rule or <br /> regulation directly relating to matters within the scope of representation proposed to be <br /> adopted by the City and shall be given the opportunity to meet with the appropriate <br /> management representatives prior to adoption. <br /> In case of emergency which the foregoing procedure is not practical or in the best public <br /> interest, the City may adopt or put into practice immediately such measures as are <br /> required. <br /> At the earliest practicable date thereafter the Union shall be provided with the notice <br /> described in the preceding paragraph and be given an opportunity to meet with the <br /> appropriate management representatives. <br /> Section 3. No Discrimination <br /> Neither the City, the Union, nor any person employed by them shall discriminate against <br /> any employee, or applicant for employment because of race, color, religion, sex, national <br /> origin, age, medical condition, pregnancy, marital status, disability or sexual orientation. <br /> Furthermore, the City shall not discriminate against any employee because of legitimate <br /> employee organization activities. <br /> Section 4. Union Representatives <br /> The Union shall submit a list of the officers of the Union to the City Manager and notify <br /> the City Manager in writing at such time there are any changes in such Union officers. <br /> Union members who are official representatives of the Union shall be given reasonable <br /> time off with pay to attend meetings with management representatives, to be present at <br /> hearings where such matters within the scope of representation are being considered, and <br /> to prepare for meet and confer sessions both prior to and following said sessions. The <br /> use of duty time for this purpose shall be reasonable and shall not interfere with the <br /> performance of City services as determined by the City. No more than three (3) Union <br /> members shall be considered official Union representatives for the purposes of this <br /> paragraph. On or about January 15 of each year the Union shall submit in writing to the <br /> Personnel Director a list of three (3) official Union representatives. The list of official <br /> Union representatives may be amended by the Union providing all such amendments are <br /> made in writing and submitted to the designated Assistant City Manager. <br /> Section 5. City Rights <br /> The rights of the City include, but are not limited to, the exclusive right to determine the <br /> mission of its constituent departments, commissions and boards; set standards of service; <br /> -9 - <br />
