In times of cold and/or wet weather, it is important that animals are <br /> provided a place where they can remain warm and dry. <br /> The proposed ordinance provides that no animal owner may leave an animal under <br /> conditions that endanger the animal's health or well-being due to heat, cold, lack of <br /> proper and adequate shelter and protection from the elements, lack of adequate <br /> ventilation, or lack of food or water, or other circumstances that could reasonably be <br /> expected to cause suffering, disability, or death to the animal. <br /> The proposed ordinance can be used a first step to educate the public regarding animal <br /> welfare laws requiring shelter and protection from the elements in homes (including <br /> Penal Code section 597) and in motor vehicles (including Penal Code section 597.7). <br /> • Section 7.36.070 (Food and Water) <br /> Animals require clean and fresh water and food daily. The presence and condition of an <br /> animal's supply of water and food is one of factors the Police Department evaluates <br /> when investigating an animal's welfare. <br /> The proposed ordinance addresses an animal's basic water and nutritional requirement <br /> in accordance with Penal Code section 597 and allows for enforcement and education <br /> on a city level. The proposed ordinance provides that every owner must give each <br /> animal a daily supply of food and water. The food must be wholesome, palatable, free <br /> from contamination, and of sufficient quantity and nutritive value to meet the normal <br /> daily requirements for the condition and size of the animal as specified by a <br /> veterinarian. The water must be clean, free from debris, and regularly changed. <br /> • Section 7.36.080 (Treatment of Sick or Injured Animals) <br /> The proposed ordinance provides that any animal requiring medical attention must be <br /> taken for examination or treatment by a veterinarian at the owner's expense if the Police <br /> Department finds that an examination or treatment is necessary to maintain the animal's <br /> health. This proposed section allows the enforcement of local laws that regulate the <br /> care and treatment of sick or injured animals.
