THE CITY OF 11 <br /> -�� ---� CITY COUNCIL AGENDA REPORT <br /> pL£ASANTON. <br /> May 21, 2013 <br /> Police <br /> TITLE: ADOPT PROPOSED AMENDMENTS TO THE PLEASANTON <br /> MUNICIPAL CODE CHAPTER 7.36 (MISCELLANEOUS ANIMAL <br /> REGULATIONS) TO REGULATE THE CARE AND TREATMENT OF <br /> ANIMALS <br /> SUMMARY <br /> Although the Pleasanton Municipal Code currently regulates the cleanliness of the <br /> premises where animals are kept, the Municipal Code does not regulate the protection <br /> of animals from the elements, treatment of sick or injured animals, or adequate food and <br /> water for animals. The California Penal Code permits the enforcement of laws <br /> regulating the care and treatment of animals under the Penal Code or other laws, <br /> including local city and county ordinances. In order to have a comprehensive approach <br /> to regulate the proper care and treatment of animals, the Police Department would like <br /> to be able to enforce local laws, in addition to the Penal Code. <br /> RECOMMENDATION <br /> Adopt the proposed ordinance to add to the Municipal Code regulations relating to the <br /> protection of animals from the elements, treatment of sick or injured animals, and supply <br /> of adequate food and water for animals. <br /> FINANCIAL STATEMENT <br /> There is no financial impact as a result of the adoption of the proposed ordinance. Any <br /> administrative penalties assessed and collected would be offset by staff administration, <br /> enforcement and prosecution costs. <br />
