MINUTES <br /> CITY OF PLEASANTON <br /> REGULAR CITY COUNCIL MEETING <br /> May 7, 2013 <br /> CALL TO ORDER <br /> Mayor Thorne called the regular meeting to order at the hour of 7:00 p.m. Councilmember Brown lead <br /> the Pledge of Allegiance and provided introductory remarks. <br /> ROLL CALL <br /> Present: Councilmembers Brown, Cook-Kallio, Pentin, Mayor Thorne <br /> Absent: One Vacancy <br /> CLOSED SESSION REPORT <br /> City Attorney Lowell reported the Council met in Closed Session for conference with labor negotiators <br /> regarding Pleasanton City Employees Association. A related agreement will be placed on the Council's <br /> May 21st agenda for public review and comment. <br /> AGENDA AMENDMENTS <br /> City Manager Fialho stated that staff has pulled Item 5, which relates to the second reading and <br /> adoption of Ordinance No. 2066, and placed it on the Council's May 21st agenda. Staff has received <br /> two correspondences from outside attorneys challenging some of the assumptions pertaining to <br /> ridgeline and hillside protections and would like to discuss them in Closed Session with the Council <br /> before acting on the second reading. <br /> CONSENT CALENDAR <br /> Administrative Services <br /> 1. Approved regular minutes of April 2, 2013, regular and special minutes of April 16, 2013 and Joint <br /> City/School minutes of January 28, 2013 <br /> City Attorney <br /> 2. Waived second reading and adopted Omnibus Ordinance No. 2065 amending various sections <br /> of the Municipal Code: §1.12.020 (Infractions) to make punishable violations of the prohibition on <br /> expanded Polystyrene Foodservice Ware; §1.20.030 (Filing of Verified Campaign Statements) to <br /> provide for all Electronic Filing; Chapter 2.29 (Youth Commission) to modify membership so not <br /> linked to specific school and change meetings to school year instead of calendar year; Chapter <br /> 5.08 (License Applications, Renewals and Conditions) regarding statements and posting; <br /> §13.08.020 (Definitions) to reflect changed department name; §13.08.090 (Sale of Goods — <br /> Exhibitions) to prohibit private lessons or classes for compensation in public parks unless <br /> approved by the City; §13.08.150 (Motor Driven Cycles and Model Vehicles and Planes) to clarify <br /> that motorized bicycles and mopeds are prohibited in City parks and that the Chief of Police can <br /> make determinations when the Vehicle Code definition is not clear; §18.116.040 (Temporary <br /> Outdoor Uses) and §18.124.170 (Temporary Use Permit) to codify existing City practices; <br /> §18.124.130 (Suspension and Revocation) to modify process for compliance with legal precedent; <br /> and add a new Section 19.40.060 (Supplemental Size and Reimbursement) to codify current <br /> practice where City can require a developer to build facilities with supplemental capacity and <br /> receive reimbursement <br />
