48. In the event that paleontological resources are encountered during the course of <br /> development, all construction activity must temporarily cease in the affected area(s) until <br /> the uncovered fossils are properly assessed by a qualified paleontologist and subsequent <br /> recommendations for appropriate documentation and conservation are evaluated and <br /> approved by the City of Pleasanton. Excavation or disturbance may continue in other <br /> areas of the site that are not reasonably suspected to overlie adjacent or additional <br /> paleontological resources. These requirements shall be printed on the site, grading, and <br /> landscape plans where applicable to the satisfaction of the Director of Community <br /> Development. <br /> 49. In the event that human remains are discovered during grading or construction, work <br /> shall stop immediately. There shall be no disposition of such human remains, other than <br /> in accordance with the procedures and requirements set forth in California Health and <br /> Safety Code Section 7050.5 and Public Resources Section 5097.98. These code <br /> provisions require notification of the County Coroner and the Native American Heritage <br /> Commission, who in turn must notify the persons believed to be most likely descended <br /> from the deceased Native American for appropriate disposition of the remains. These <br /> requirements shall be printed on the site, grading, and landscape plans where applicable <br /> to the satisfaction of the Director of Community Development. <br /> 50. The applicant/developer shall implement construction best management practices to <br /> reduce construction noise, including: <br /> a) Locate stationary construction equipment as far from adjacent occupied buildings as <br /> possible. <br /> b) Select routes for movement of construction-related vehicles and equipment so that <br /> noise-sensitive areas, including residences and outdoor recreation areas, are avoided <br /> as much as possible. Include these routes in materials submitted to the City of <br /> Pleasanton for approval prior to the issuance of building permits. <br /> c) All site improvements and construction activities shall be limited to the hours of 8:00 <br /> a.m. to 5:00 p.m., Monday through Saturday. In addition, no construction shall be <br /> allowed on State and federal holidays. If complaints are received regarding the <br /> Saturday construction hours, the Community Development Director may modify or <br /> revoke the Saturday construction hours. The Community Development Director may <br /> allow earlier "start times" for specific construction activities (e.g., concrete <br /> foundation/floor pouring), if it can be demonstrated to the satisfaction of the <br /> Community Development Director that the construction and construction traffic noise <br /> will not affect nearby residents. Prior to construction, the hours of construction shall <br /> be posted on site. <br /> d) All construction equipment must meet DMV and City noise standards and shall be <br /> equipped with muffling devices. <br /> e) Designate a noise disturbance coordinator who will be responsible for responding to <br /> complaints about noise during construction. The telephone number of the noise <br /> disturbance coordinator shall be conspicuously posted at the construction site and <br /> shall be provided to the City of Pleasanton. Copies of the construction schedule shall <br /> also be posted at nearby noise sensitive areas. <br /> 8 of 30 <br />
