A. Housing units and structures in residential developments that are 11 units or greater shall <br /> not be placed on slopes of 25 percent or greater or within 100 vertical feet of a ridgeline. <br /> Housing units include, but are not limited to, apartments, co-operatives (co-ops), air-space <br /> condominiums, townhomes, multi-family homes, and single-family detached homes. <br /> B. Commercial structures are prohibited on hillside slopes of 25 percent or greater, or within <br /> 100 vertical feet of a ridgeline. <br /> C. Grading to construct the above-referenced residential or commercial structures is <br /> prohibited on hillside slopes of 25 percent or greater, or within 100 vertical feet of a <br /> ridgeline. <br /> 18.70.030 Non Applicability. <br /> This chapter does not apply to the following: <br /> A. Housing developments of ten or fewer units on a single property that was, as of January <br /> 1, 2007, a legal parcel pursuant to the California Subdivision Map Act (California <br /> Government Code §§ 66410 — 66413). Splitting, dividing, or sub-dividing a legal parcel <br /> created prior to January 1, 2007 to obtain more than ten housing units is not allowed. <br /> B. City facilities. Examples of City facilities include water tanks and parks and recreation <br /> areas for pedestrian, bicycle, or equestrian trails or staging areas. <br /> C. The provisions of this chapter shall not apply to roads, as they are considered <br /> infrastructure rather than structures. <br /> 18.70.040 Implementation. <br /> The regulations of this chapter shall be implemented through the City's Design Review <br /> and Planned Unit Development Rezoning/Development Plan entitlements, processes, and <br /> modifications of these entitlements, as follows: <br /> A. The regulations of this chapter are applied in conjunction with State and Federal <br /> regulations and City regulations, policies, and programs on, but not limited to, ridgeline <br /> and hillside protection, protection of jurisdictional waters, species, and habitat areas, <br /> trees, wildland fire mitigation, urban storm water runoff treatment and necessary <br /> environmental mitigation, etc. <br /> B. Where the regulations of this chapter may conflict with other provisions of this title <br /> including, but not limited to, Chapter 18.76 H-P-D Hillside Planned Development District, <br /> Chapter 18.68 PUD Planned Unit Development District, and Chapter 18.78 West Foothill <br /> Road Corridor Overlay District, the regulations of this chapter shall control. <br /> 18.70.050 Definitions. <br /> The terms used in this chapter shall have the following meaning: <br /> A. Contour Interval. <br /> Contour interval means the difference in elevation between adjacent contour lines <br /> on a contour map or topographical map. <br /> 4 <br />
