Policy 308: The County shall not permit development within any area outside the Urban Growth <br /> Boundary exceeding 25 percent slopes to minimize hazards associated with slope instability. <br /> Infrastructure is defined as: "Infrastructure shall include public facilities, community facilities, and all <br /> structures and development necessary to the provision of public services and utilities." <br /> "The ridgelines above Happy Valley south of Pleasanton" is included as a sensitive viewshed in <br /> Policy 105. <br /> Hillside development restrictions are more restrictive that Measure PP and housing can not be built <br /> on slopes of more than 20%. <br /> Spotorno/Happy Valley Bypass Road <br /> All proposed alignments for the Happy Valley Bypass Road and a great portion of the Spotorno <br /> property are outside the voter adopted city Urban Growth Boundary (UGB) adopted in 1996 and <br /> county Urban Growth Boundary adopted in 2000. On June 16, 1998, the city council was told by <br /> Brian Swift (previous Planning Director) in response to Sharrell Michelotti's and Becky <br /> Dennis' questions, who responded that to change the urban boundary line would require approval of a <br /> vote of the people (city of Pleasanton). <br /> The Happy Valley Bypass Road and any housing subdivision or portion of a housing subdivision <br /> outside the UGB cannot be approved unless a vote of the Pleasanton people agrees that the Urban <br /> Growth Boundary should be expanded. The "Blue Ribbon Committee" which was a planning task <br /> force convened by the city manager in the 2006-2007 time frame had no representation from the <br /> Planning department, including then Planning Director Jerry Iserson. <br /> The "Blue Ribbon Committee" was a planning task force that discussed various subdivisions and <br /> roads outside the Urban Growth Boundary. I do not see anywhere in the Minutes where the "Blue <br /> Ribbon Committee" was explained that they were performing an analysis on roadways and <br /> subdivisions that would breach the voter adopted city and county Urban Growth Boundary. <br /> I have marked the approximate city and county Urban Growth Boundary on the "Blue Ribbon <br /> Committee" report on the last page in Attachment C. Note that that the Happy Valley Bypass Road <br /> and 1/3 of the proposed housing subdivision lies outside the Urban Growth Boundary. <br /> I would request that the city manager inform the current city council that much of this land lies outside <br /> of the Urban Growth Boundary and that a vote of the people of Pleasanton is required to expand the <br /> Urban Growth Boundary. I can find no City Council minutes since the departure of Deborah Acosta <br /> McKeehan in late 2004 that discusses that a vote of the people of Pleasanton is needed to expand <br /> the Urban Growth Boundary. No urban development or infrastructure can be constructed outside the <br /> city and county UGB without a vote of the people to expand the UGB. Just because the city annexes <br /> property does not mean that the city can start developing outside the city and county UGB. <br /> Municipal Code <br /> Retain the H-P-D Municipal Code Chapter. Densities decrease as slope increases. All <br /> developments that have an average slope of greater than 10% must be H-P-D PUDs. Ensure that <br /> developments meet the H-P-D specifications. <br /> General Plan <br /> 4 <br />
