years. The developer would be obligated to pay the applicable development impact <br /> fees which are in effect when the ordinance approving the agreement is effective. The <br /> agreement allows the City to utilize the project's in-lieu park dedication fees towards <br /> improving community parks in the City, including Phase II of Bernal Community Park. <br /> The agreement also ensures that the developer will provide a number and range of <br /> affordable housing units acceptable to the City. Since the Planning Commission <br /> hearing, staff added a condition of approval (no. 3) requiring the applicant to execute <br /> the development agreement within 10 days of the City Council's second reading of the <br /> ordinance approving the development agreement. <br /> Growth Management <br /> The growth management agreement for the project is included with Attachment 4. The <br /> agreement states that all 305 units will receive growth management approval in 2014. <br /> The growth management allocations for the project are included in the proposed <br /> development agreement and would be extended into the future for the term of the <br /> development agreement. <br /> Exceptions Requested by Applicant <br /> The project conforms to most of the Standards. As described on page 12 in the <br /> attached Planning Commission staff report, the applicant is requesting three exceptions <br /> to the Standards: parallel parking is not provided on one side of the street by the <br /> leasing/community buildings; garage doors are not recessed two feet at some locations; <br /> and retail storefronts do not meet the minimum depth at some locations. Staff supports <br /> the requested exceptions. <br /> HOUSING COMMISSION ACTION <br /> At its February 21, 2013, meeting, the Housing Commission reviewed an Affordable <br /> Housing Agreement (AHA) for the project, which included 36 affordable units as <br /> described in Option 1 in the above table. The Housing Commission did not take action <br /> on the AHA, but continued the item, directing staff to meet again with the applicant to <br /> work toward providing 46 affordable units. <br /> Staff then met with the applicant on a number of occasions in an attempt to develop an <br /> affordability level and unit mix that most closely reflects the intent of the City's <br /> Inclusionary Zoning Ordinance (IZO), City development standards and design <br /> guidelines, and the Housing Commission's interest. As an outcome of those <br /> discussions, a revised AHA was created (Option 2 in the above table). The Housing <br /> Commission reviewed the revised AHA on March 21, 2013. The Housing Commission <br /> took no action on the two options as it felt that more units should be provided at the <br /> lower levels of affordability. Minutes of the Housing Commission meetings are included <br /> as Attachment 7. <br /> PLANNING COMMISSION ACTION <br /> The Planning Commission held a public hearing on March 27, 201:3, to review the <br /> proposed project. Detailed information on this meeting is provided by Attachment 6, <br /> draft excerpts of the Planning Commission minutes.
