I wanted to summarize and restate my position on a few key areas f that chapter for your consideration before your final recommenda;ion to the C:t,y Council on this item. Measure PP that was passed by the voters in November 2.008 provides: 1. Housing units and structures shall not be placed on slopes of 25% or greater or within 100 vertical feet of a ridgeiine. Also, no grading to construct residential (more than 10 units) or commercial structures shail occur on slopes of 25% or ,greater or within 100 vertical feet of a Pidgeline. O. The provisions of Measure PP inay be amended or repealed only by the voters of the City of Pleasanton at a city general election. c. The provisions of Measure PP override any existing General Plan. 3ecause Measure PP overrides the existing General Plan, which by reference includes Specific Plans, there should be no exemption for any struc:ures included In Specific Plans or the General Plan; the Planning Commission agreed to state ?hat structures included in an Approved PUO were not subject to Measure PP ;ecause vested property rights had already been granted. The Planning Commission has already determined that streets and roads are structures, in .rgreement with the city municipal code definition as well as the Catfornia building code definition, and forwarded their finding to the City Council; the City Council `hen agreed 5 70 that streets and roads are structures. a reality, it should not have even been necessary for Measure PP to specify that he measure overrides the General Plan; cur citizens certainly expect that a passing vote overrides everything else (unless, of course, it involves a vested ' >gal right).
