I wanted to summarize and restate my position on a few key areas <br /> f that chapter for your consideration before your final recommenda;ion to the <br /> C:t,y Council on this item. <br /> Measure PP that was passed by the voters in November 2.008 provides: <br /> 1. Housing units and structures shall not be placed on slopes of 25% or <br /> greater or within 100 vertical feet of a ridgeiine. Also, no grading to <br /> construct residential (more than 10 units) or commercial structures shail <br /> occur on slopes of 25% or ,greater or within 100 vertical feet of a <br /> Pidgeline. <br /> O. The provisions of Measure PP inay be amended or repealed only by the <br /> voters of the City of Pleasanton at a city general election. <br /> c. The provisions of Measure PP override any existing General Plan. <br /> 3ecause Measure PP overrides the existing General Plan, which by reference <br /> includes Specific Plans, there should be no exemption for any struc:ures included <br /> In Specific Plans or the General Plan; the Planning Commission agreed to state <br /> ?hat structures included in an Approved PUO were not subject to Measure PP <br /> ;ecause vested property rights had already been granted. The Planning <br /> Commission has already determined that streets and roads are structures, in <br /> .rgreement with the city municipal code definition as well as the Catfornia building <br /> code definition, and forwarded their finding to the City Council; the City Council <br /> `hen agreed 5 70 that streets and roads are structures. <br /> a reality, it should not have even been necessary for Measure PP to specify that <br /> he measure overrides the General Plan; cur citizens certainly expect that a <br /> passing vote overrides everything else (unless, of course, it involves a vested <br /> ' >gal right).
