ORDINANCE NO. AN OMNIBUS ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON ADOPTING MODIFICATIONS TO THE PLEASANTON MUNICIPAL CODE TO: AMEND §1.12.020 (INFRACTIONS) TO MAKE PUNISHABLE VIOLATIONS OF THE PROHIBITION ON EXPANDED POLYSTYRENE FOODSERVICE WARE; AMEND §1.20.030 (FILING OF VERIFIED CAMPAIGN STATEMENTS) TO PROVIDE FOR ALL ELECTRONIC FILING; AMEND CHAPTER 2.29 (YOUTH COMMISSION) TO MODIFY MEMBERSHIP SO NOT LINKED TO SPECIFIC SCHOOL AND CHANGE MEETINGS TO SCHOOL YEAR INSTEAD OF CALENDAR YEAR; AMEND CHAPTER 5.08 (LICENSE APPLICATIONS, RENEWALS AND CONDITIONS) REGARDING STATEMENTS AND POSTING; AMEND §13.08.020 (DEFINITIONS) TO REFLECT CHANGED DEPARTMENT NAME; AMEND §13.08.090 (SALE OF GOODS — EXHIBITIONS) TO PROHIBIT PRIVATE LESSONS OR CLASSES FOR COMPENSATION IN PUBLIC PARKS UNLESS APPROVED BY THE CITY; AMEND §13.08.150 (MOTOR DRIVEN CYCLES AND MODEL VEHICLES AND PLANES) TO CLARIFY THAT MOTORIZED BICYCLES AND MOPEDS ARE ALSO PROHIBITED IN CITY PARKS AND THAT THE CHIEF OF POLICE CAN MAKE DETERMINATIONS WHEN THE VEHICLE CODE DEFINITION IS NOT CLEAR; AMEND §18.116.040 (TEMPORARY OUTDOOR USES) AND §18.124.170 (TEMPORARY USE PERMIT) TO CODIFY EXISTING CITY PRACTICES; AMEND §18.124.130 (SUSPENSION AND REVOCATION) TO MODIFY PROCESS FOR COMPLIANCE WITH LEGAL PRECEDENT; AND ADD A NEW SECTION 19.40.060 (SUPPLEMENTAL SIZE AND REIMBURSEMENT) TO CODIFY CURRENT PRACTICE WHERE CITY CAN REQUIRE A DEVELOPER TO BUILD FACILITIES WITH SUPPLEMENTAL CAPACITY AND RECEIVE REIMBURSEMENT WHEREAS, provisions of the Pleasanton Municipal Code need to be amended to comply with new State laws or reflect current City practices and changed department names, as well as correct errors; and WHEREAS, this omnibus ordinance involves one action by the City Council to bring up- to-date and correct multiple non-controversial provisions of the Municipal Code. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1. The Municipal Code is amended as follows: a. Amend §1.12.020 Infractions as follows: A. Notwithstanding Section 1.12.010 of this chapter, any person who violates a provision of this code designated in this chapter shall be guilty of an infraction, punishable by: 1. A fine not exceeding $100.00 for the first violation; 2. A fine not exceeding $200.00 for a second violation of the same ordinance within one year; 3. A fine not exceeding $500.00 for the third violation of the same ordinance within one year. Any person who violates the same ordinance more than three times in any 12-month period shall be guilty of a misdemeanor.
