Therefore,the following language is in the Rules of Procedure under Section 2-7 Duties of <br /> Executive Director: <br /> Establish a Technical Advisory Group("TAG")consisting of at least one staff representative from <br /> each Agency to advise Energy Council staff on matters such as strategic planning, annual work <br /> plans,funding priorities, proposed program design, coordination with existing energy service <br /> providers and programs(e.g., East Bay Energy Watch), and other matters related to advancing <br /> sustainable energy initiatives. Energy Council staff shall cause summary minutes of all TAG <br /> meetings to be kept and shall, as soon as possible after each meeting, cause a copy of the <br /> summary minutes to be forwarded to each member of the Board and to each TAG <br /> representative.As matters discussed at the TAG are considered by the Board, Energy Council <br /> staff shall also include a summary of TAG input in the staff's report on the matter to the Board. <br /> TAG members may also speak on any given matter in front of the Board. <br /> Comment A-2: Process for forming the proposed JPA. Please provide additional clarity on the process <br /> for the Alameda County local governments'governing bodies to consider membership in the proposed <br /> JPA. In particular, please provide a timeline for the local governments' consideration of becoming a <br /> member of the JPA,a sample resolution that includes the request to become a member of the JPA, and <br /> any other supporting documentation that local government staff can use to inform their governing <br /> bodies'consideration of the matter. In addition, please specify if the JPA must be formed initially by a <br /> subset of member agencies after which other agencies then join, or if there is an alternative approach to <br /> forming the JPA. <br /> Response A-2: <br /> If the Waste Management Authority Board directs staff to distribute for formal consideration <br /> the proposed JPA language at its meeting on September 26, 2012,any of the 14 cities of <br /> Alameda County or the County itself may join by signing the Joint Powers Agreement before <br /> March 29, 2013 (this is the"effective date"of the JPA and would be the first day of the Energy <br /> Council's existence). At least two public agencies must sign the JPA before March 29,2013 for <br /> the JPA to take effect and form the Energy Council. After that date, a city(or the County),within <br /> or outside of Alameda County, may become a member of the Energy Council if approved by the <br /> Energy Council Board. <br /> There are other ways in which a JPA could be formed,such as on the date when a specified <br /> number of agencies have signed the Joint Powers Agreement(e.g., all 14 Cities in the County, <br /> and the County). But having a date certain by which the Council will begin provides the <br /> governance structure funders are looking for. We've drafted formation language that <br /> maximizes the size and likelihood of grant funding. The California Public Utilities Commission <br /> has around$160 million available to fund local government energy efficiency proposals for <br /> program implementation beginning January 1, 2013, and we've already submitted applications <br /> (reviewed and coordinated through TAG)for about$11 million over the next two years. We see <br /> no reason for any potential agency within Alameda County to need more than about six months <br /> 2 <br />
