The EIR, SEIR and the Mitigation Monitoring and Reporting Plan are incorporated <br /> herein by this reference. <br /> M. The Cities of Pleasanton and Livermore, the County of Alameda, SPA and the <br /> Developers have been working collaboratively toward the completion of necessary plans, <br /> approvals and permitting necessary for the development of the Staples Ranch Project in <br /> Pleasanton. As provided in Order R2-2009-0074 NPDES Permit CAS612008, dated <br /> October 14, 2009, development projects deemed complete after December 1 , 2009 will <br /> be subject to the October 14, 2009 Order. Conversely, development projects deemed <br /> complete before December 1, 2009 will be subject to NPDES Permit CAS0029831 <br /> (Order No. R2-2003-0021, as amended by Order No. R2-2007-0025) that was in effect <br /> until November 30, 2009. The application for the Stoneridge Drive Specific Plan <br /> Amendment was deemed complete in October 2008, the application for the Continuing <br /> Care Site was deemed complete in January 2009, the application for the Auto Mall Site <br /> was deemed complete in February 2009, the application for the Community Park was <br /> deemed complete in May 2009 and the application for the Neighborhood Pirk was <br /> deemed complete in October 2009. <br /> N. City has determined that the Staples Ranch Project presents certain public <br /> benefits and opportunities which are advanced by City and SPA entering into this <br /> Agreement. This Agreement will, among other things, (1) reduce uncertainties in <br /> planning and provide for the orderly development of the Staples Ranch Project; <br /> (2) mitigate many significant environmental impacts; (3) provide public infrastructure; <br /> (4) strengthen City's economic base with a variety of short-term construction jobs; <br /> (5) provide for and generate substantial revenues for City in the form of one time and <br /> annual fees and exactions, sales tax revenues, and other fiscal benefits; (6) provide a <br /> variety of needed services for seniors, including personal care/skilled nursing; (7) result <br /> in the funding of critical citywide facilities and other infrastructure improvements; <br /> (8) result in the dedication of 17 acres for a Community Park Site; (9) result in City's <br /> acquisition of the Neighborhood Park Site; and (10) otherwise achieve the goals and <br /> purposes for which the Development Agreement Statute was enacted. <br /> O. In exchange for the benefits to City described in the preceding Recital, <br /> together with the other public benefits that will result from the development of the <br /> Staples Ranch Project, SPA and Developers will receive by this Agreement assurance <br /> that it has a vested right to proceed with the Staples Ranch Project in accordance with <br /> Applicable Law (defined below) but subject to the availability of water and therefore <br /> desires to enter into this Agreement. <br /> P.. The City Council, after conducting a duly noticed public hearing, has found <br /> that this Agreement is consistent with the General Plan, the Stoneridge Drive Specific <br /> Plan as amended and City's zoning ordinance, and has conducted all necessary <br /> proceedings in accordance with City's rules and regulations for the approval of this <br /> Agreement. <br /> Q. On June 24, 2009, following a duly noticed public hearing, the Planning <br /> Commission adopted Resolution No. 1 1 recommending that the City Cotmcil approve <br /> 4 <br />
