RESOLUTION NO. <br /> RESOLUTION, DECLARING THAT WEEDS, DIRT, RUBBISH, AND REFUSE <br /> UPON OR IN FRONT OF CERTAIN DESCRIBED PROPERTIES WITHIN THE <br /> CITY OF PLEASANTON CONSTITUTE PUBLIC NUISANCES AND THAT <br /> THEY BE ABATED, AND SETTING A PUBLIC HEARING REGARDING THE <br /> ABATEMENT <br /> WHEREAS, there is attached hereto and incorporated by reference herein as if <br /> fully set forth a list of properties to which this resolution applies; and <br /> WHEREAS, said list of properties specifically sets forth street, lot and block <br /> numbers according to the official assessment map for each piece of property; and <br /> WHEREAS, the properties list have, upon or in front of them, weeds, as defined <br /> by Section 39561.5 of the Government Code, dirt, rubbish, or refuse; and <br /> WHEREAS, after consideration of evidence, it appears that said weeds, dirt, <br /> rubbish, and refuse are a public nuisance in that they constitute a fire hazard, or that <br /> said materials are noxious or dangerous and as such, are detrimental to the health, <br /> safety and welfare of the City of Pleasanton and, as such, shall be removed; and <br /> WHEREAS, it appears that the public nuisances referred to herein are recurrent <br /> and seasonal in nature. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br /> CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER <br /> THE FOLLOWING: <br /> SECTION 1. That the weeds, dirt, rubbish and refuse upon on or in front of the <br /> properties described in the list of attached hereto and incorporated by reference herein, <br /> are declared a public nuisance and are to be abated and removed pursuant to the <br /> procedure provided by Section 39560-39588 of the Government Code. <br /> SECTION 2. City Clerk shall certify to the passage of this resolution and enter it <br /> into the book of original resolutions. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of <br /> Pleasanton at a regular meeting held on March 19, 2013 <br />
