III. DISPUTE RESOLUTION PROCESS <br /> A. Initiation of Request. The City Manager may meet on an issue or issues of <br /> interest to a Resident or the Park Owner, including the calculations used for a rent increase. The <br /> request must be in writing but shall not require any particular number of signatures beyond that <br /> of the person making the request. The request must identify the problem(s) to be addressed by <br /> the City Manager and may recommend a solution. <br /> B. Prerequisite to Written Request. The City Manager may consider a request only <br /> after the following events have occurred: <br /> 1. The Resident(s) making the request has submitted the issue in writing to <br /> the Park Owner (or to the Park Owner's representative); the Park Owner making the <br /> request has submitted the issue in writing to the Residents. <br /> 2. A satisfactory resolution of the issue has not been achieved within 30 days <br /> from the written submittal. <br /> The City Manager may select whatever professional persons are deemed necessary to assist in <br /> reviewing the request. <br /> C. Dispute Resolution. If the City Manager is unable to resolve the issue to the <br /> satisfaction of all parties, the procedures of Chapter 1.28 of the Pleasanton Municipal Code <br /> (Administrative Remedies) shall be employed to resolve the dispute. For purposes of that <br /> Chapter, the Director shall mean an Assistant or Deputy City Manager of the City of Pleasanton. <br /> IV. ESTABLISHMENT OF MONTHLY RENTS AND RENT INCREASES <br /> A. Current Monthly Rents. As of the date of this Agreement, the Monthly Rent for <br /> each space within the Fairview Trailer Park is set forth in Exhibit A attached to this Agreement <br /> and incorporated herein by reference. <br /> B. Monthly Rents Effective January 1, 2008. Effective January 1, 2008, the Monthly <br /> Rent for each space within the Fairview Trailer Park is set forth in Exhibit B attached to this <br /> Agreement and incorporated herein by reference. <br /> C. Rent Increases Generally, Beginning January 1, 2009, annual rent increases shall <br /> be calculated as provided in Article VI. Nothing herein shall be construed to require that the <br /> Park Owner increase rents in any given year by the maximum permitted under this Agreement. <br /> If the Park Owner increases rents in any year by less than the maximum permitted pursuant to <br /> Article VI, then the Park Owner shall have the right in the next subsequent year to increase rents <br /> by the difference between the maximum permitted rent increase pursuant to Article VI for the <br /> two year period and the actual rent increase actually taken in the first year. <br /> 4 <br />
