CI%Y COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COFNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1025 <br /> <br /> ORDINANCE A}~NDING CttAPTER 15 (CONDOMINII~.I CON- <br /> VERSION PROJECTS) OF TITLE II (ZONING AND DEVELOP~ENT) <br /> OF TttE ORDINANCE CODE OF TIM CITY OF PLEASANTON AT <br /> SECTIONS 2-25.04 AND 2-25.13 TO PROHIBIT P~TALIATORY <br /> EVICTIONS <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEAS~J]TON DOES ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: That Section 2-25.05 (General Requirements For <br /> All Condominium Conversion Projects: Approving <br /> Body Powers.) of Chapter 15, Title II of the <br /> Ordinance Code of the City of Pleasanton be amended <br /> as follows: <br /> <br /> 1. Delete the word "or" before subsection (c). <br /> <br /> 2. Add the following in its entirety: <br /> <br /> "or (d) the approving body finds that the <br /> applicant for conversion evicted a tenant <br /> immediately before or during the condominium <br /> conversion process in violation of Section 2- <br /> 25.13(b)." <br /> <br />Section 2: That Section 2-25.13 (Public Policy: Lease <br /> Provisions) of Chapter 15, Title II of the Ordinance <br /> Code of the City of Pleasanton be amended as <br /> follows: <br /> <br /> 1. The title shall be modified to read as follo~Ts: <br /> "Public Policy: Lease Provisions; Evictions." <br /> <br /> 2. The existing paragraph shall be numbered (a) <br /> and the word "avert" on line two shall be <br /> amended to read "subvert." <br /> <br /> 3. Subsection (b) shall be added in its entirety <br /> to read as follows: <br /> <br /> "(b)" It shall be against the public policy <br /> embodied in this Chapter to evict or threaten <br /> to evict or otherwise harass any tenant <br /> because of said tenant's refusal to consent <br /> to conversion, said tenant's opposition to <br /> such conversion or the anticipated refusal or <br /> opposition of said tenant." <br /> <br /> <br />
