Code Sections 65583 and 65589.5 and with the 2012 Pleasanton General Plan Housing Element <br /> pertaining to emergency homeless shelters and supportive and transitional housing <br /> Community Development Director Dolan presented the staff report, stating that the purpose of the <br /> ordinance is to amend various Chapters of Title 18 of the Municipal Code to comply with changes to the <br /> California Government code and the 2012 Housing Element. As required by SB2 and agreed to in the <br /> Housing Element, the ordinance would establish a new overlay district in selected areas of the City <br /> wherein homeless shelters would be allowed as a permitted use, subject to specific development <br /> standards, and would clarify how the Municipal Code applies to supportive and transitional housing. <br /> SB2 requires that local jurisdictions provide zoning where emergency homeless shelters are allowed as <br /> a permitted use, subject to the same standards that apply to other residential or commercial <br /> development within the same zone as well as the potential for certain additional development <br /> standards. SB2 also requires that supportive and transitional housing be treated as a residential use <br /> subject only to those restrictions that apply to other residential dwellings of the same type in the same <br /> zone. The following definitions are used for the purposes of applying SB2: <br /> • Emergency shelter— used interchangeably with homeless shelter; housing with minimal support <br /> services for homeless persons that is limited to occupancy of 6 months or less; <br /> • Supportive housing— housing geared towards a target population, with on or off site services to <br /> support residents and no limit to length of stay; <br /> • Transitional housing — similar to residential rental development with program requirements that <br /> call for the termination of assistance and recirculation of the unit to another eligible recipient at <br /> some predetermined point to exceed a minimum of 6 months. <br /> Program 46.1 of the 2012 Housing Element obligated the City to perform public outreach and revise the <br /> zoning code within one year of adoption. It also identified the Service-Commercial (CS) Zone as a likely <br /> location for such a use. Mr. Dolan reviewed a map depicting the two areas within the CS Zone with <br /> potential to develop such a facility, which the ordinance proposes to include in a new Service-Facilities <br /> (SF) Overlay District. In addition to existing zoning standards for the CS district, staff has added <br /> development standards in the following areas: <br /> • Maximum of 50 beds to house 50 persons, allowed at 1 bed for every 400 feet' of lot area; <br /> • Off-street parking to be provided at the ratio of 1 space for every 4 beds, each employee and <br /> each company vehicle; <br /> • Length of stay limited to 90 consecutive days with a possible extension to 180 days in the <br /> absence of alternative housing possibilities; <br /> • Minimum 300 foot radius between homeless shelters (maximum allowable under state law); <br /> • Exterior and interior client areas; <br /> • Trash and recycling storage; <br /> • Onsite management and security; <br /> • Noise regulations; <br /> • Maximum and minimum lighting requirements, as appropriate for commercial buildings; <br /> • Provision of a management plan; <br /> • Provision of food service to comply with the County Department of Public Health requirements <br /> As noted, supportive and transitional housing shall be considered a residential use of property and <br /> subject only to those restrictions applied to other residential dwellings of the same type in the same <br /> zone. Program 46.2 of the Housing Element again requires the City to conduct public outreach and <br /> amend the current code within one year of adoption. As proposed, the amendment would allow for 6 or <br /> fewer residents in a dwelling as a permitted unit in applicable zones.
