RESOLUTION NO. 13-591 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, AUTHORIZING APPLICATION FOR AN ENERGY EFFICIENCY LOAN FROM THE CALIFORNIA ENERGY COMMISSION WHEREAS, the City of Pleasanton has committed to reducing energy demand in the city; and WHEREAS, the City of Pleasanton has committed to meeting the greenhouse gas emission reduction goals established by the California Global Warming Solutions Act of 2006 (AB32); and WHEREAS, the California Energy Commission provides loans to schools, hospitals, local governments, special districts, and public care institutions to finance energy efficiency improvements; and WHEREAS, the City Council recognizes that the California Energy Commission has limited one percent loans available, and projects are funded on a first-come first-served basis; and WHEREAS, the City of Pleasanton will repay any California Energy Commission loan through energy savings achieved. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. The City Council authorizes the City Manager to apply for an energy efficiency loan from the California Energy Commission to implement energy efficiency measures for an amount up to $3 million. SECTION 2. In compliance with the California Environmental Quality Act (CEQA), the City Council finds that the activity funded by the loan is categorically exempt under Section 15303, Class 3(d). SECTION 3. If recommended for funding by the California Energy Commission, the City Council authorizes the City Manager to execute all loan documents in a `orm approved by the City Attorney. SECTION 4. The amount of the loan will be paid in full, plus interest, under the terms and conditions of the Loan Agreement, Promissory Note and Tax Certificate of the California Energy Commission. SECTION 5. The City Manager is hereby authorized to execute, all necessary loan, equipment, and service documents and direct all work necessary to complete the energy efficiency projects. PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at a regular meeting held on January 15, 2013.
