Attachment 1 <br /> RESOLUTION NO. <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br /> AUTHORIZING APPLICATION FOR AN ENERGY EFFICIENCY LOAN FROM THE <br /> CALIFORNIA ENERGY COMMISSION <br /> WHEREAS, the City of Pleasanton has committed to reducing energy demand in the <br /> city; and <br /> WHEREAS, the City of Pleasanton has committed to meeting the greenhouse gas <br /> emission reduction goals established by the California Global Warming Solutions Act of 2006 <br /> (AB32); and <br /> WHEREAS, the California Energy Commission provides loans to schools, hospitals, <br /> local governments, special districts, and public care institutions to finance energy efficiency <br /> improvements; and <br /> WHEREAS, the City Council recognizes that the California Energy Commission has <br /> limited one percent loans available, and projects are funded on a first-come first-served basis; <br /> and <br /> WHEREAS, the City of Pleasanton will repay any California Energy Commission loan <br /> through energy savings achieved. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. The City Council authorizes the City Manager to apply for an energy <br /> efficiency loan from the California Energy Commission to implement energy efficiency measures <br /> for an amount up to $3 million. <br /> SECTION 2. In compliance with the California Environmental Quality Act (CEQA), the <br /> City Council finds that the activity funded by the loan is categorically exempt under Section <br /> 15303, Class 3(d). <br /> SECTION 3. If recommended for funding by the California Energy Commission, the City <br /> Council authorizes the City Manager to execute all loan documents in a form approved by the <br /> City Attorney. <br /> SECTION 4. The amount of the loan will be paid in full, plus interest, under the terms <br /> and conditions of the Loan Agreement, Promissory Note and Tax Certificate of the California <br /> Energy Commission. <br /> SECTION 5. The City Manager is hereby authorized to execute, all necessary loan, <br /> equipment, and service documents and direct all work necessary to complete the energy <br /> efficiency projects. <br /> SECTION 6. City Clerk shall certify to the passage of this resolution and enter it into <br /> the book of original resolutions. <br />
