In addition to amending Chapter 18.08 (Definitions), attached as Exhibit <br /> A, to define cottage food operations, the addition of Chapter 18.108 (Cottage food <br /> operations), attached as Exhibit A, would codify a permit process and performance <br /> standards for cottage food operations. <br /> If adopted, these proposed Code amendments would allow Pleasanton residents to <br /> prepare and package the following types of non-perishable foods from their homes, and <br /> then sell such food either from their homes or from other locations: <br /> State Health and Safety Code §114365.5 - "Foods and food products <br /> allowed to be produced at cottage food operations includes, but is not <br /> limited to "nonpotentially hazardous foods" described as: <br /> (1) Baked goods without cream, custard, or meat fillings, such as <br /> breads, biscuits, churros, cookies, pastries, and tortillas. <br /> (2) Candy, such as brittle and toffee. <br /> (3) Chocolate-covered nonperishable foods, such as nuts and dried fruit. <br /> (4) Dried fruit. <br /> (5) Dried pasta. <br /> (6) Dry baking mixes. <br /> (7) Fruit pies, fruit empanadas, and fruit tamales. <br /> (8) Granola, cereals, and trail mixes. <br /> (9) Herb blends and dried mole paste. <br /> (10) Honey and sweet sorghum syrup. <br /> (11) Jams, jellies, preserves, and fruit butter. <br /> (12) Nut mixes and nut butters. <br /> (13) Popcorn. <br /> (14) Vinegar and mustard. <br /> (15) Roasted coffee and dried tea. <br /> (16) Waffle cones and pizelles." <br /> In order to comply with the two new assembly bills, and to ensure that cottage food <br /> operators will be in compliance with the Pleasanton Municipal Code (PMC), staff <br /> proposes the following text amendments. <br /> Definition (PMC 18.08.117 Cottage food operations) <br /> The following definition is intended to clarify cottage food operations. <br /> "Cottage food operation" means an enterprise within the registered or permitted (by the <br /> Alameda County Department of Environmental Health Food Safety Division) area of a <br /> private home or apartment, or other multi-family housing (i.e. condominiums or <br /> townhomes), where the individual, who proposes to operate the cottage food operation <br /> in his or her private residence and is the owner of the cottage food operation, prepares <br /> and for packages cottage food products that are not potentially hazardous foods for <br /> direct or indirect sale to consumers.
