No trash shall be dumped outside of the enclosed building area between the <br /> hours of 9:00 p.m. and 8:00 a.m. In the alternative, a business which finds it <br /> necessary or convenient to dump trash between 9:00 p.m. and 8:00 a.m. may <br /> demonstrate pursuant to Section 9.04.110 of this chapter that sound levels from <br /> dumping trash are insignificant or have been adequately mitigated. This <br /> subsection does not prohibit regularly scheduled pick up of trash by commercial <br /> garbage companies. <br /> 5. The person in charge of a business premises, whether that person is an owner, <br /> employee, agent or contractor, shall be responsible to assure compliance with <br /> subsections 1 through 4 of this section. <br /> 6. The owner of each business subject to this section shall be responsible to inform <br /> his or her managers, employees, agents and contractors of the requirements of <br /> this section. <br /> B. Amend Chapter 18.08 Definitions, Section 18.08.523 to add a definition for <br /> "Special Downtown Accessory Entertainment Use" and Section 18.08.055 to modify <br /> the definition of a "bar" to read as follows: <br /> 18.08.523 Special Downtown Accessory Entertainment Use. <br /> "Special downtown accessory entertainment use" means the following type of <br /> accessory use approved by the City on or after January 4, 2013 in the area <br /> designated Downtown Hospitality Central Core or Downtown Hospitality <br /> Transition Area: live entertainment, including music, poetry readings, stand-up <br /> comedy, and performance art; disc jockey music; dancing; or other similar use as <br /> determined by the zoning administrator. A special downtown accessory <br /> entertainment use does not include adult entertainment establishment uses, as <br /> defined in Chapter 18.114 of this code. <br /> 18.08.55 Bar. <br /> "Bar" means any premises in which alcoholic beverages are regularly offered for <br /> sale and on-site consumption excluding restaurants that only sell alcoholic <br /> beverages between 6:00 a.m. and 11:00 p.m. A restaurant which sells alcoholic <br /> beverages anytime after 11:00 p.m. and before 6:00 a.m. shall be classified as a <br /> bar for purposes of this zoning code. <br /> C. Amend Chapter 18.116, Temporary Uses, Section 18.116.060 to add Special <br /> Downtown Accessory Entertainment Use requirements to read as follows: <br /> 18.116.060 Special downtown accessory entertainment uses. <br /> If expanded operation hours are requested for a special downtown accessory <br /> entertainment use which would otherwise adhere to the permitted use <br /> parameters in Table 18.44.090, the expanded hours may be approved by the <br /> zoning administrator provided the findings required by Section 18.124.070 are <br /> made by the zoning administrator, and the expanded hours are proposed for a <br /> special downtown accessory entertainment use in the Downtown Hospitality <br /> Central Core Area; are proposed for a holiday celebration; are proposed in <br /> conjunction with a downtown special event; and/or effective noise attenuation is <br /> installed. Expanded operation hours shall be approved for no more than 5 <br /> calendar days a year. No public hearing shall be held unless requested by the <br /> zoning administrator. <br />
