ORDINANCE NO. 2055 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> AMENDING CHAPTER 9.04 (NOISE REGULATIONS), CHAPTER 18.08 <br /> (DEFINITIONS), CHAPTER 18.44 (C COMMERCIAL DISTRICTS), CHAPTER 18.74 <br /> (DOWNTOWN REVITALIZATION DISTRICT), CHAPTER 18.11E (TEMPORARY <br /> USES) OF THE PLEASANTON MUNICIPAL CODE, AS FILED UNDER CASE P12- <br /> 0798 <br /> WHEREAS, at its meeting of November 14, 2012, the Planning Commission <br /> recommended that the City Council amend sections of Chapter 9.04 (Noise Regulations), <br /> Chapter 18.08 (Definitions), Chapter 18.44 (C Commercial Districts), Chapter 18.74 (Downtown <br /> Revitalization District), Chapter 18.116 (Temporary Uses) of the Pleasanton Municipal Code to <br /> create a Downtown Hospitality Area, add Special Downtown Accessory Entertainment Uses, <br /> amend definitions, and amend the Noise Regulations; and <br /> WHEREAS, at its meeting of November 27, 2012, the City Council reviewed the report <br /> of the Director of Community Development regarding the amendments to Chapter 9.04 (Noise <br /> Regulations), Chapter 18.08 (Definitions), Chapter 18.44 (C Commercial Districts), Chapter <br /> 18.74 (Downtown Revitalization District), Chapter 18.116 (Temporary Uses) of the Pleasanton <br /> Municipal Code and the recommendations of the Planning Commission. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> ORDAIN AS FOLLOWS: <br /> SECTION 1. The City Council finds that the proposed amendments to the Pleasanton <br /> Municipal Code are consistent with the Pleasanton General Plan. <br /> SECTION 2. The Municipal Code is amended as follows: <br /> A. Amend Chapter 9.04 Noise Regulations, to create regulations for the Downtown <br /> Hospitality Central Core Area and Downtown Hospitality Transition Area, Section <br /> 9.04.035, 9.04.040, and 9.04.043 to read as follows: <br /> 9.04.035 Noise limits—Commercial or industrial use adjacent to residential zone. <br /> Any commercial or industrial use, not including a special downtown accessory <br /> entertainment use in the Downtown Hospitality Transition Area, which is located within <br /> 300 feet from any residential zone and which remains open for business at any time <br /> between the hours of 10:00 p.m. and 6:00 a.m. shall adhere to the following standards of <br /> performance: <br /> 9.04.040 Noise limits—Commercial property. <br /> No person shall produce or allow to be produced by any machine, animal, device, or any <br /> combination of the same, on commercial property, a noise level in excess of 70 dBA at <br /> any point outside of the property plane, unless otherwise provided in this chapter. <br />
