RESOLUTION NO. 12-577 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON APPROVING <br /> THE THIRD AMENDMENT TO THE FREEWAY MAINTENANCE AGREEMENT WITH <br /> CALTRANS FOR FUTURE STATE HIGHWAYS IN THE CITY OF PLEASANTON <br /> WHEREAS, an Agreement for maintenance of State Highways, as provided for in Section <br /> 130 of the Streets and Highways Code, was executed by the City of Pleasanton on February 6, <br /> 1990, and by the State of California on February 27, 1990; and <br /> WHEREAS, the Agreement authorizes the City of Pleasanton to operate and maintain <br /> Caltrans owned traffic signals within the City of Pleasanton; and <br /> WHEREAS, this Agreement has been amended previously to include additional traffic <br /> signals; and <br /> WHEREAS, traffic signals have been constructed at the I-680/Bernal Avenue Interchange; <br /> and <br /> WHEREAS, traffic signals will be constructed at the I-580/Foothill Road Interchange; and <br /> WHEREAS, the parties desire to amend the Agreement to include the I-680/Bernal Avenue <br /> Interchange and the I-580/Foothill Road traffic signals. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. The Freeway Maintenance Agreement between the City of Pleasanton and <br /> the State of California is hereby amended to include new page number 6a dated November 20, <br /> 2012, attached and incorporated herein by reference, which shall be substituted for like numbered <br /> pages in said Agreement, and shall cancel and supersede previous like numbered pages, and <br /> become a part of said Agreement for all purposes. <br /> SECTION 2. All other terms and conditions of the Agreement shall remain in full force and <br /> effect. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at a <br /> regular meeting held on November 20, 2012. <br /> I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the foregoing <br /> resolution was adopted by the City Council at a regular meeting held on the 20`h day of November, <br /> 2012 by the following vote: <br /> Ayes: Councilmembers Cook-Kallio, McGovern, Sullivan, Vice Mayor Thorne <br /> Noes: None <br /> Absent: Mayor Hosterman <br /> Abstain: None S <br /> A./ _ <br /> Karen •iaz, City Cler <br /> APPROVED AS TO FORM: <br /> J n P.
