ATTACHMENT 1 RESOLUTION NO. 12- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, CALLING FOR THE HOLDING OF AN ALL MAIL BALLOT SPECIAL MUNICIPAL ELECTION ON TUESDAY, MAY 7, 2013, TO FILL A VACANCY AS REQUIRED BY THE PROVISIONS OF THE LAWS OF THE STATE OF CALIFORNIA RELATING TO GENERAL LAW CITIES AND PROVISIONS OF THE PLEASANTON MUNICIPAL CODE WHEREAS, a vacancy in the office of Councilmember was created by Jerry Thorne sworn in as Mayor on December 4, 2012; and WHEREAS, the term of office in which the vacancy occurs ends November 2014. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That pursuant to the requirements of the laws of the State of California relating to general law cities and provisions of the Municipal Code there is called and ordered to be held in the City of Pleasanton, on Tuesday, May 7, 2013 a Special Municipal Election conducted by all mail ballot for the purpose of the election of a Councilmember for the term of office in which the vacancy was created by the election of Jerry Thorne as Mayor which ends November 2014. SECTION 2. That the ballots to be used at the election shall be in form and content as required by law. SECTION 3. That the City Clerk is authorized, instructed and directed to coordinate with the County of Alameda Registrar of Voters to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct the election by all mail ballot. SECTION 4. That the County Registrar of Voters is authorized to canvass the returns of the All Mail Ballot Special Municipal Election. SECTION 5. That in all particulars not recited in this resolution, the election shall be held and conducted as provided by law for holding municipal elections. SECTION 6. That pursuant to the State Elections Code, the City of Pleasanton Municipal Code said Special Election shall be conducted by all mail ballot, and shall be conducted pursuant to Chapter 2 of Division 4 (Commencing with Section 4100) of the California Elections Code only insofar as required by law, and only where not inconsistent with ordinances of the City of Pleasanton. Notwithstanding Elections Code Section 4103, ballots cast in this Special Election shall be returned to the office of the City Clerk no later than 8 p.m. on election day. Only ballots received in the office of the City Clerk by 8 o'clock p.m. on election day shall be counted. SECTION 7. That notice of the time and place of holding the election is given and the City Clerk is authorized, instructed and directed to give further or additional notice of the election, in time, form and manner as required by law.
