THE CITY OF 16 <br /> -- -- CITY COUNCIL AGENDA REPORT <br /> PL E ASANTON. <br /> December 4, 2012 <br /> Administrative Services <br /> TITLE: CALL FOR AN ALL MAIL BALLOT SPECIAL ELECTION TO BE HELD <br /> ON MAY 7, 2013 TO FILL A CITY COUNCIL VACANCY <br /> SUMMARY <br /> When Councilmember Thorne is sworn in as Mayor, there will be a vacancy on the City <br /> Council for the remainder of his term ending November 2014. The Municipal Code <br /> provides that a vacancy be filled by a special election at the next regularly scheduled <br /> election date not less than 114 days from the call of the special election. As a result, <br /> based on established elections schedules, the earliest this election could occur is May <br /> 7, 2013, which is an established (pursuant to the California Elections Code), all mail <br /> ballot election. Assuming the election is held on May 7, 2013, the elected candidate <br /> would assume office on approximately June 4, 2013. The nomination period for the May <br /> election is from January 14, 2013 to February 8, 2013. <br /> RECOMMENDATIONS <br /> Adopt the attached Resolution Calling for a Special Mail Ballot Election to be held on <br /> May 7, 2013 to fill a City Council Member vacancy; and authorize an appropriation in <br /> the amount of $250,000 from the General Fund Contingency to the City Clerk Election <br /> account. <br /> FISCAL IMPACT <br /> The Registrar of Voters estimates the cost to conduct a standalone Mail Ballot Election <br /> between four and five dollars per registered voter without costs related to the Sample <br /> Ballot, postage, Spanish, Chinese, Tagalog and Vietnamese translations. Including <br /> these costs, at the high end, the total election costs are estimated at $250,000. Funding <br /> for this will come from the General Fund Contingency. <br />
