Attachment 1 <br /> FIRST AMENDMENT TO AGREEMENT PROVIDING FOR RENT STABILIZATION <br /> OF MOBILEHOME SPACE RENTS <br /> This Amendment is entered into this day of December, 2012, by and between the <br /> following parties: <br /> Edmund S. Gil and Barbara H. Gil, as principal owner of Fairview Trailer Park, 785 Rose <br /> Avenue, Pleasanton, A.P.N. 94-127-36-1), (hereinafter referred to as "Park Owner"), and the <br /> City of Pleasanton, a municipal corporation (hereinafter referred to as "City"). <br /> Recitals <br /> A. Park Owner and City entered into an Agreement Providing for Stabilization of <br /> Mobilehome Space Rents on October 16, 2007 (hereinafter referred to as "Agreement"). <br /> B. The Agreement is due to expire on December 31, 2012. <br /> C. The Parties desire to extend the term of the Agreement for another five years and make <br /> other minor revisions consistent with such an extension. <br /> NOW, THEREFORE, in consideration of the faithful performance of the terms, conditions, and <br /> covenants set forth herein, the parties agrees as follows: <br /> 1. Section X (Term) of the Agreement is amended to read: <br /> "The Agreement shall take effect on January 1, 2008 and shall terminate on December <br /> 31, 2017." <br /> 2. Section IV (Establishment of Monthly Rents and Rent Increases), part D (Rent Increases <br /> Upon a Transfer of Ownership), subpart 1 is amended to read: <br /> "1. Upon a Transfer of Ownership, the Park Owner of the Fairview Trailer Park may <br /> increase the Adjusted Monthly Rent for a mobilehome space as follows: <br /> During 2008, $750 <br /> During 2009, $775 <br /> During 2010, $800 <br /> During 2011, $825 <br /> During 2012, $850 <br /> During 2013, $875 <br /> During 2014, $900 <br /> During 2015, $925 <br /> During 2016, $950 <br /> During 2017, $975." <br /> 1 <br />
