CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 03-071 <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />RESOLUTION DENYING THE APPEAL (PAP-48) THEREBY <br />UPHOLDING THE DENIAL OF THE APPLICATION OF <br />BRETT HOFFMAN AS FILED UNDER CASE <br />PV-83/PADE-736 <br /> <br />on April 2, 2003, the Zoning Administrator denied the application of Brett <br />Hoffman for a variance and administrative design review to allow an existing <br />detached shed to maintain a zero (0) foot sideyard setback from the western side <br />yard property line where a three-foot sideyard setback is required for the property <br />located at 7356 Maywood Drive; and <br /> <br />the property is zoned R-1-6,500 (Single Family Residential: 6,500-square foot <br />minimum lot size) District; and <br /> <br />within the time specified by the Pleasanton Municipal Code, the applicant filed an <br />appeal of the Zoning Administrator's decision; and <br /> <br />at its meeting of April 23, 2003, the Planning Commission denied the appeal and <br />upheld the Zoning Administrator's denial; and <br /> <br />within the time specified by the Pleasanton Municipal Code, the applicant filed an <br />appeal of the Planning Commission's denial; and <br /> <br />a duly noticed public hearing was held before the City Council on June 3, 2003, at <br />which time all pertinent testimony and documents were reviewed; and <br /> <br />projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br /> <br />the City Council determined that (1) the subject lot does not exhibit any special <br />circumstances unique to the site depriving the property of privileges enjoyed by <br />other similarly situated and zoned properties; (2) the proposal would constitute a <br />grant of special privilege; and (3) this request would jeopardize the health, safety, <br />and general welfare of the surrounding area. <br /> <br /> <br />
