Public Comment <br /> Kelly Cousins asked to know the voting history of each Council candidate, what motivates them, where <br /> they stand on a number of important issues, and how their campaign is funded. After viewing the From <br /> 460's of candidates, she was disappointed but not surprised to see significant donations from James <br /> Tong, Charter Properties, their associates, and several other developers and investment landowners <br /> from outside of Pleasanton. Most noteworthy are the contributions to Erlene Demarcus, a paid <br /> consultant for Charter Properties and an individual who facilitated that developer's support towards <br /> other City Council campaigns. This level of campaign funding impacts a candidate's decisions and <br /> influences the future of the community. She encouraged the public to view candidates' Forms 460 on <br /> the City's website to see how each ranks with respect to accepting large donations from corporations, <br /> PACs and groups outside the City of Pleasanton. She also encouraged this and future Councils to <br /> develop a more rigorous ordinance concerning campaign funding that is in keeping with the spirit of the <br /> Political Reform Act and more popular disclosure efforts. <br /> Kay Ayala asked that the Mayor direct the City Attorney to explain what, if anything, a majority vote by <br /> the Council could do to change the City's current direction with respect to the outstanding lawsuit <br /> brought by the Tong/Lin development groups. She noted that these same development groups and <br /> their associates have donated a combined total of $32,000 to the Erlene Demarcus campaign. She <br /> stated that during her own time on the Council Ms. Demarcus, acting as a paid consultant for the <br /> Lin/Tong development community, had requested a meeting with her regarding a particular <br /> development project and intimated that Mr. Tong might help to support her next campaign. She said <br /> she attended the meeting, considered the development, ultimately said she would not support it and <br /> subsequently received no contributions from Mr. Tong. She also noted that former Mayor Tom Pekoe, <br /> who served as a consultant for Charter Properties, and Jennifer Hosterman for Congress have made <br /> significant contributions to Ms. Demarcus' campaign. <br /> Mayor Hosterman asked the City Attorney to comment to the extent possible, given that the City is <br /> involved in existing litigation with the individuals identified. <br /> City Attorney Lowell stated that a Council majority does have the authority to direct him on how to <br /> defend against, resolve, or otherwise address the lawsuit. <br /> City Council Minutes Page 2 of 12 October 16,2012 <br />
