THE CITY OF ^ "' CITY COUNCIL AGENDA REPORT 1 pL£ASANTON- November 27, 2012 Economic Development Community Development Planning Division TITLE: PUBLIC HEARING: CONSIDERATION OF DOWNTOWN HOSPITALITY GUIDELINES (P11-0824) FOR COMMERCIAL BUSINESSES AND SPECIAL EVENTS WITHIN THE DOWNTOWN SPECIFIC PLAN AREA (DOWNTOWN) AND RELATED PLEASANTON MUNICIPAL CODE (PMC) AMENDMENTS (P12-0798) INCLUDING: THE CREATION OF NEW HOSPITALITY DISTRICTS, AND NEW HOUR, NOISE, AND OPERATION REQUIREMENTS FOR HOSPITALITY USES DOWNTOWN; AND A CITY-WIDE PMC AMENDMENT CHANGING WHEN A RESTAURANT SERVING ALCOHOL MUST APPLY FOR A CONDITIONAL USE PERMIT; AND (2) THE NEGATIVE DECLARATION FOR THE DOWNTOWN HOSPITALITY GUIDELINES AND RELATED CODE AMENDMENTS SUMMARY In October 2011, the Pleasanton City Council appointed an 11-member ad hoc Downtown Hospitality Guidelines (DHG) Task Force to develop a set of hospitality guidelines for entertainment, music, and special events that would address key elements in creating a positive and responsible environment for downtown vitality. The DHG Task Force met between October 2011 and May 2012 to discuss ideas and create draft guidelines. As the process evolved, a set of preliminary draft Pleasanton Municipal Code (PMC) amendments was prepared to implement the commercial business regulations proposed. The DHG Task Force completed its effort by recommending set of Draft DHG. The vote was not unanimous ((3-5 vote) which reflected the members' mixed opinions as to how restrictive the proposed guidelines should be. The attached draft guidelines reflect the DHG as recommended by the DHG Task Force, with recommended changes by staff. Staff's changes include the Planning Commission's recommended changes. The City Council is asked to consider approval of the attached draft DHG, PMC amendments, and Negative Declaration. ECONOMIC VITALITY COMMITTEE ACTION On June 14, 2012 the Economic Vitality Committee (EVC) reviewed the Draft DHG. The EVC's recommending votes were unanimous. The EVC's June 14 meeting summary is provided in Attachment 8. Its full recommendation is below.
