THE CITY OF ^ <br /> "' CITY COUNCIL AGENDA REPORT 1 <br /> pL£ASANTON- <br /> November 27, 2012 <br /> Economic Development <br /> Community Development <br /> Planning Division <br /> TITLE: PUBLIC HEARING: CONSIDERATION OF DOWNTOWN HOSPITALITY <br /> GUIDELINES (P11-0824) FOR COMMERCIAL BUSINESSES AND <br /> SPECIAL EVENTS WITHIN THE DOWNTOWN SPECIFIC PLAN AREA <br /> (DOWNTOWN) AND RELATED PLEASANTON MUNICIPAL CODE <br /> (PMC) AMENDMENTS (P12-0798) INCLUDING: THE CREATION OF <br /> NEW HOSPITALITY DISTRICTS, AND NEW HOUR, NOISE, AND <br /> OPERATION REQUIREMENTS FOR HOSPITALITY USES <br /> DOWNTOWN; AND A CITY-WIDE PMC AMENDMENT CHANGING <br /> WHEN A RESTAURANT SERVING ALCOHOL MUST APPLY FOR A <br /> CONDITIONAL USE PERMIT; AND (2) THE NEGATIVE DECLARATION <br /> FOR THE DOWNTOWN HOSPITALITY GUIDELINES AND RELATED <br /> CODE AMENDMENTS <br /> SUMMARY <br /> In October 2011, the Pleasanton City Council appointed an 11-member ad hoc <br /> Downtown Hospitality Guidelines (DHG) Task Force to develop a set of hospitality <br /> guidelines for entertainment, music, and special events that would address key <br /> elements in creating a positive and responsible environment for downtown vitality. The <br /> DHG Task Force met between October 2011 and May 2012 to discuss ideas and create <br /> draft guidelines. As the process evolved, a set of preliminary draft Pleasanton <br /> Municipal Code (PMC) amendments was prepared to implement the commercial <br /> business regulations proposed. The DHG Task Force completed its effort by <br /> recommending set of Draft DHG. The vote was not unanimous ((3-5 vote) which <br /> reflected the members' mixed opinions as to how restrictive the proposed guidelines <br /> should be. The attached draft guidelines reflect the DHG as recommended by the DHG <br /> Task Force, with recommended changes by staff. Staff's changes include the Planning <br /> Commission's recommended changes. The City Council is asked to consider approval <br /> of the attached draft DHG, PMC amendments, and Negative Declaration. <br /> ECONOMIC VITALITY COMMITTEE ACTION <br /> On June 14, 2012 the Economic Vitality Committee (EVC) reviewed the Draft DHG. <br /> The EVC's recommending votes were unanimous. The EVC's June 14 meeting <br /> summary is provided in Attachment 8. Its full recommendation is below. <br />
