RESOLUTION NO. 12-574 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, APPROVING AN AMENDMENT TO THE GENERAL PLAN HOUSING ELEMENT MODIFYING PROGRAM 9.1 AND THE SECTION ON POTENTIAL GOVERNMENTAL CONSTRAINTS TO HOUSING IN THE BACKGROUND, AS FILET) UNDER CASE P12-1691 WHEREAS, after the adoption of the Housing Element on February 13, 2012, the California Department of Housing and Community Development (HCD) responded to the City's submittal in a letter of May 17, 2012, and requested additional changes and information to meet State housing law; and WHEREAS, amendments have been drafted to make a minor change to Program 9.1 and to add information to the Background material; and WHEREAS, HCD has stated in a letter of August 23, 2012, that the Housing Element, if amended with the proposed changes, will comply with the State Housing Element Law; and WHEREAS, on September 12, 2012, the Planning Commission held a public hearing on the proposed amendments to the Housing Element and made a positive recommendation to the City Council; and WHEREAS, a Supplemental Environmental Impact Report (SEIR) was prepared for the Housing Element Update project, and the City Council adopted a resolution certifying the SEIR as complete and adequate in compliance with the California Environmental Quality Act on January 4, 2012; and WHEREAS, the amendments described in Exhibit A consist of a minor change to Program 9.1 and additions to the Background and are consistent with the Housing Element project as described and analyzed in the certified SEIR and no further environmental assessment need be conducted; and WHEREAS, a duly noticed public hearing was held by the City Council on October 2, 2012 with respect to this General Plan Amendment. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: SECTION 1. The General Plan Amendment modifying Housing Element Program 9.1 and the Background information relating to potential governmental restraints to housing, as shown in Exhibit A, attached hereto and made part of this resolution by reference, and thereby amending the Housing Element adopted on February 13, 2012, is hereby approved. SECTION 2. The City Council determines that this is the third of four times in 2012 that the Housing Element of the General Plan may be amended as provided in Government Code Section 65358. SECTION 3. This resolution shall become effective immediately upoi its passage and adoption.
