CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1005 <br /> <br /> APPROVING THE APPLICATION OF HARRY AND EVELYN R. <br /> HEMPY AND ROBERT AND MARGARET STARNES TO REZONE <br /> A NINE (.9) ACRE SITE ON THE WEST SIDE OF FOOTHILL <br /> ROAD, NORTH OF HIGHLAID OAKS DRIVE IN THE VICINITY <br /> OF 5050 AND 5100 FOOTHILL ROAD FROM A (AGRICULTURE) <br /> TOPUD-LOW DENSITY RESIDENTIAL DISTRICT <br /> <br />WHEREAS, Harry and Evelyn R. Hempy and Robert and Margaret Starnes <br /> applied to have an approximately nine (9) acre site <br /> located on the west side of Foothill Road, north of <br /> Highland Oaks Drive in the vicinity of 5050 and 5100 <br /> Foothill Road from A (Agriculture) to PUD-Low Density <br /> Residential District; and <br /> <br />WHEREAS, based on the Initial EnviroD~ental Study indicating <br /> no significant adverse effects on the environment, a <br /> negative declaration was adopted by Council on <br /> October 27, 1981; and <br /> <br />WHEREAS, Council received the Planning Commission's recommenda- <br /> tion for approval of the rezoning; and <br /> <br />WHEREAS, a duly noticed public hearing was held on October 27, <br /> 1981, and <br /> <br />Wt~REAS, City Council finds that this rezoning is consistent <br /> with the General Plan policies of the City of Pleasanton. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES t~REBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: Approves the rezoning of an approximately nine (9) <br /> acre site located on the west side of Foothill Road, <br /> north of Highland Oaks Drive in the vicinity of 5050 <br /> and 5100 Foothill Road from A (Agriculture) to PUD- <br /> Low Density Residential District, subject to the follow- <br /> ing conditions: <br /> <br /> a. That this rezoning is only for the 5.48 acre site <br /> known as 5000 Foothill Road and the 3.48 acre site <br /> known as 5050 Foothill Road. <br /> <br /> b. That the applicant be aware that either in conjunction <br /> with development plan approval of the subject properties <br /> or subdivision of the subject properties, the staff <br /> will request full utilities (including sewer) be <br /> provided to both parcels, and that depending upon <br /> the number of new parcels proposed, that a minimum <br /> <br /> <br />
