04-Ala 580 PM R21 3/R21.9 AMENDMENT NUMBER 2 FREEWAY MAINTENANCE AGREEMENT IN THE CITY OF PLEASANTON This Amendment No. 2 to the Freeway Maintenance Agreement in the City of Pleasanton is made and entered into by and between the State of California, acting by and through the Department of Transportation, hereinafter referred to as "STATE", and the City of Pleasanton, hereinafter referred to as "CITY." WITNESSETH: WHEREAS, a Freeway Maintenance Agreement in the City of Pleasanton, hereinafter referred to as "AGREEMENT", was executed by CITY and by STATE on October 20, 1978; and WHEREAS, on November 5, 2003, an Amendment to said Freeway Maintenance Agreement was executed by the PARTIES, hereinafter referred to as "AMENDMENT 1"; and WHEREAS, AGREEMENT by its terms provides that it may be amended at any time upon mutual consent of the parties; and WHEREAS, under STATE Encroachment Permit 144' but Z - WIC- t9U,lissued on jk;rn" 2S,Cu z, to CITY desires to reconstruct State Highway Route 580 (Route 580) at the Foothill Road interchange by constructing an auxiliary lane to the eastbound Route 580 Foothill Road diagonal off-ramp, eliminating the eastbound Route 580 to northbound Foothill Road loop off-ramp, and realigning the eastbound diagonal on and off-ramps to a signalized intersection at the Foothill Road, constructing sidewalks along Foothill Road/San Ramon Road in the northbound direction, and installing crosswalks; and WHEREAS, the parties hereto now desire that AGREEMENT be amended. NOW, THEREFORE, the parties agree to amend AGREEMENT as follows: I. Upon written notification by STATE to CITY that said planned future improvement is accepted, the attached pages dated February 14, 2012, shall be substituted for the Exhibit "A" in AGREEMENT, and shall cancel and superseded the Exhibit"A" in AGREEMENT for all purposes. In all other respects, AGREEMENT shall remain in full force and effect.
