Transfer of Units <br /> The current GMO contains language governing the "trading" of units from one year to <br /> the next and historically, the Council has permitted the reallocation or transfer of <br /> unallocated units in previous years to a future year. However, while the majority of this <br /> language has been retained without modification (some related directly to specific <br /> suballocations has been deleted), the Subcommittee determined it appropriate that the <br /> language be amended to reflect that the trading and transfers are permitted at the <br /> discretion of the City Council and provided that they do not result in the total number of <br /> unit allocations exceeding the number of units assigned to the City in a specific RHNA <br /> cycle. As such, Section 17.36.090 (D) now includes the following: <br /> "The city council shall have the discretion to approve rules or procedures concerning the use, <br /> loss, trade, reallocation, and assignment of growth management approvals which vary from the <br /> subsections A, B, or C of this section if it occurs as part of a project developer's development <br /> agreement or other legislative act so long as the overall number of allowed permits do not <br /> exceed the total number of assigned to the city for the current Regional Housing Needs <br /> Allocation cycle." <br /> Application to Prior Approved Projects <br /> As part of the 1999 GMO amendment, language was added attempting to categorize <br /> previously approved growth management approvals that were outstanding as a specific <br /> type of suballocation. However, staff has reviewed outstanding development approvals <br /> and determined that this section (17.36.120) has minimal applicability to the current <br /> status of growth management approvals much, and therefore this specific provision has <br /> been deleted.
