RESOLUTION NO. 12-566 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br /> APPROVING A CONDITIONAL USE PERMIT APPLICATION TO OPERATE A <br /> STATE-REGISTERED HERITAGE SCHOOL AT THE TRI-VALLEY CHINESE BIBLE <br /> CHURCH LOCATED AT 1055 SERPENTINE LANE WITH UP TO 60 STUDENTS (P12- <br /> 0841) <br /> WHEREAS, the Applicant, the Tri-Valley Church has requested approval to operate a <br /> State-Registered Heritage School inside the existing building located at 1055 Serpentine Lane; <br /> and <br /> WHEREAS, the school would operate Monday through Friday with Jp to 60 students <br /> from Kindergarten to fifth grade; and <br /> WHEREAS, the Applicant has also applied for a PUD Major Modification (PUD-80-01- <br /> 12M) to allow State-registered Heritage School as a conditional use in the Valley Business Park; <br /> and <br /> WHEREAS, the subject property is zoned PUD-I (Planned Unit Development — <br /> Industrial) District; and <br /> WHEREAS, a complete application for the project is available for review at the <br /> Community Development Department; and <br /> WHEREAS, the Planning Commission reviewed the proposed Conditional Use Permit <br /> during a Public Hearing on August 22, 2012 and adopted a Resolution recommending that the <br /> City Council approve the Conditional Use Permit request; and <br /> WHEREAS, the Applicant has submitted a Written Narrative which includes a schedule, <br /> site plan and floor plan, dated received by the Planning Division on July 17, 2012; and <br /> WHEREAS, the City Council has determined that the proposed project is Categorically <br /> Exempt from the California Environmental Quality Act pursuant to Section 15303, Class 3; and <br /> WHEREAS, the City Council makes the following findings: <br /> A. That the proposed location of the conditional use is in accordance with the objectives of <br /> the zoning ordinance and the purpose of the district in which the site is locate because: <br /> Objectives of the zoning ordinance include: fostering a harmonious, convenient, <br /> workable relationship among land uses; protecting existing land use from inharmonious <br /> influences and harmful intrusions; and insuring that public and private lands ultimately <br /> are used for the purposes which are most appropriate and beneficial to the City as a <br /> whole. As conditioned, the proposed heritage school will be consistent with these <br /> objectives. Tutoring facilities, a private school/day care center arid music lessons <br /> currently operate in the Valley Business Park and have been found to be compatible with <br /> the surrounding businesses. The proposed Heritage School will be conducted indoors <br /> and on a property with adequate circulation and parking to support the use. <br />
