THE CITY OF n 2 <br /> ■ <br /> - -� CITY COUNCIL AGENDA REPORT 1 L <br /> pLEASANTONe <br /> October 2, 2012 <br /> City Manager <br /> TITLE: ADOPTION OF RESOLUTION TO OPT-IN TO THE ALAMEDA COUNTY <br /> MANDATORY COMMERCIAL RECYCLING ORDINANCE AND UPDATE <br /> REGARDING PLEASANTON GARBAGE SERVICE'S REQUEST FOR A <br /> RATE ADJUSTMENT <br /> SUMMARY <br /> In February of this year, staff presented the City Council with a report regarding the <br /> Alameda County Waste Management Authority (ACWMA) Board's (Stopwaste) <br /> Ordinance Requiring Action to Reduce Landfilling of Recyclable and Organic Solid <br /> Waste from Businesses, Multi-Family Residences, and Self Haulers (Mandatory <br /> Commercial Recycling Ordinance) and a Single-Use Bag Reduction Ordinance both of <br /> which were recently approved by Stopwaste. At the time, the City Council adopted the <br /> Single Bag Reduction Ordinance but deferred a decision on the Mandatory Commercial <br /> Recycling Ordinance until completion of an anticipated request from Pleasanton <br /> Garbage for a collection and recycling rate adjustment. While that rate review is <br /> currently in progress, discussions to date indicate that the cost of implementing the <br /> County's ordinance will not be significantly more than implementing the already enacted <br /> State AB341 which set forth requirements for mandatory commercial' recycling on a <br /> state level. As a result, staff is recommending that it inform Stopwaste of its intent to <br /> "opt-in" to the County's ordinance. <br /> Pleasanton Garbage has submitted a request to adjust refuse collection rates for all <br /> residential and commercial refuse services. City staff, the City Council Refuse and <br /> Recycling Subcommittee (City Council Subcommittee) comprised of Mayor Hosterman <br /> and Councilmember Sullivan, and the City's consultant, The Newpoint Group, Inc., have <br /> met on a number of occasions to discuss PGS's proposal. However, an agreement has <br /> not yet been reached and staff is working to finalize the negotiations within thirty days. <br /> RECOMMENDATION <br /> 1.) Approve the resolution (Attachment A) notifying Stopwaste that the City will opt-in to <br /> the county-wide Mandatory Commercial Recycling Ordinance. <br /> 2.) Provide any comment regarding the current rate review process. <br /> FINANCIAL STATEMENT <br /> There is no direct financial impact to the City as a result of this action. The rate review <br /> will lead to increased monthly fees for residences and businesses. <br />
