Box 520 Pleasanton, CA 94566 Recording requested Pursuant to Government Code Sections 27383 & 6103 RECIPROCAL LICENSE AGREEMENT THIS RECIPROCAL LICENSE AGREEMENT (hereinafter "Agreement"), is made and entered into this day of September 2012, by and between The City of Pleasanton, a Municipal Corporation (hereinafter "City") and the Castlewood Country Club, a Mutual Benefit Corporation, incorporated under the laws of the State of California (hereinafter"Castlewood"). RECITALS WHEREAS Castlewood owns certain real property in Alameda County, California (hereafter referred to as "Castlewood Property") a portion of which is bounded essentially by the Arroyo de Laguna to the west and Mission Creek to the north and property owned by the City more specifically identified in Exhibit "A"; and WHEREAS, City owns certain real property northerly of and adjacent to the Castlewood Property (hereafter referred to as "City Property" more specifically identified in Exhibit "B"; and WHEREAS, the City Property was previously owned by the City and County of San Francisco and the City and County of San Francisco, acting by and through its Public Utilities Commission (hereinafter "SFWD") is obligated to provide water to Castlewood from wells in City. SFWD transports water from the SFWD wells north of Castlewood property south to Castlewood through underground pipelines located in part on the City Property; and WHEREAS, Castlewood desires to make improvements to certain water supply facilities immediately adjacent to a portion of the SFWD Facilities and at the shared property line or within the City Property; WHEREAS, City desires, now or in the future, to have access to the City Property from the Castlewood Property for maintenance purposes or in order to make improvements and the City Property is difficult to access except through the Castlewood property; and 1
