OF 5 <br /> THE CITY O <br /> t °' ° "' CITY COUNCIL AGENDA REPORT <br /> pL£ASANTON. <br /> September 18, 2012 <br /> Community Development <br /> Planning Division <br /> TITLE: CONSIDER APPLICATIONS FOR: (1) PUD-80-01-12M, A PLANNED <br /> UNIT DEVELOPMENT (PUD) MAJOR MODIFICATION TO THE <br /> APPROVED PLANNED UNIT DEVELOPMENT GOVERNING VALLEY <br /> BUSINESS PARK TO ALLOW STATE-REGISTERED HERITAGE <br /> SCHOOLS AS A CONDITIONAL USE ON ALL PROPERTIES; AND <br /> (2) P12-0841, A CONDITIONAL USE PERMIT TO OPERATE A STATE- <br /> REGISTERED HERITAGE SCHOOL WITH A MAXIMUM OF <br /> 60 STUDENTS AT THE TRI-VALLEY CHINESE BIBLE CHURCH <br /> LOCATED AT 1055 SERPENTINE LANE <br /> SUMMARY <br /> The applicant proposes to amend the PUD for Valley Business Park to allow State- <br /> registered Heritage Schools to operate in the Valley Business Park with approval of a <br /> Conditional Use Permit. The applicant has also requested approval of a Conditional Use <br /> Permit to operate a Heritage School with up to 60 students at 1055 Serpentine Lane. <br /> Staff and the Planning Commission believe that State-registered Heritage Schools are <br /> compatible with the Valley Business Park and the proposed Heritage School at the <br /> Tri-Valley Chinese Bible Church, as conditioned, will be compatible with the surrounding <br /> area. <br /> PLANNING COMMISSION ACTION <br /> Recommended approval of the applications (5-0 vote), subject to the conditions of <br /> approval recommended by staff. <br /> RECOMMENDATION <br /> 1 . Find that the proposed PUD Major Modification is consistent with the General Plan <br /> and purposes of the PUD ordinance; <br /> 2. Introduce the attached draft Ordinance (Attachment 1) approving Case <br /> PUD-80-01-12M; and <br /> 3. Make the Conditional Use Permit Findings as listed on pages 10-11 of the attached <br /> Planning Commission Staff Report and adopt a Resolution (Attachment 2) approving <br /> a Conditional Use Permit (P12-0841) subject to the Conditions of Approval. <br /> FINANCIAL STATEMENT <br /> The Applicant will be required to pay any impact fee(s) associated with the proposed <br /> use prior to opening the School. Therefore, staff believes that the proposed project will <br /> have no fiscal impact on the City. <br />
