September 18, 2012 Community Development Planning Division TITLE: CONSIDER APPLICATIONS FOR: (1) PUD-80-01-12M, A PLANNED UNIT DEVELOPMENT (PUD) MAJOR MODIFICATION TO THE APPROVED PLANNED UNIT DEVELOPMENT GOVERNING VALLEY BUSINESS PARK TO ALLOW STATE-REGISTERED HERITAGE SCHOOLS AS A CONDITIONAL USE ON ALL PROPERTIES; AND (2) P12-0841, A CONDITIONAL USE PERMIT TO OPERATE A STATE- REGISTERED HERITAGE SCHOOL WITH A MAXIMUM OF 60 STUDENTS AT THE TRI-VALLEY CHINESE BIBLE CHURCH LOCATED AT 1055 SERPENTINE LANE SUMMARY The applicant proposes to amend the PUD for Valley Business Park to allow State- registered Heritage Schools to operate in the Valley Business Park with approval of a Conditional Use Permit. The applicant has also requested approval of a Conditional Use Permit to operate a Heritage School with up to 60 students at 1055 Serpentine Lane. Staff and the Planning Commission believe that State-registered Heritage Schools are compatible with the Valley Business Park and the proposed Heritage School at the Tri-Valley Chinese Bible Church, as conditioned, will be compatible with the surrounding area. PLANNING COMMISSION ACTION Recommended approval of the applications (5-0 vote), subject to the conditions of approval recommended by staff. RECOMMENDATION 1 . Find that the proposed PUD Major Modification is consistent with the General Plan and purposes of the PUD ordinance; 2. Introduce the attached draft Ordinance (Attachment 1) approving Case PUD-80-01-12M; and 3. Make the Conditional Use Permit Findings as listed on pages 10-11 of the attached Planning Commission Staff Report and adopt a Resolution (Attachment 2) approving a Conditional Use Permit (P12-0841) subject to the Conditions of Approval. FINANCIAL STATEMENT The Applicant will be required to pay any impact fee(s) associated with the proposed use prior to opening the School. Therefore, staff believes that the proposed project will have no fiscal impact on the City.
