RESOLUTION NO. <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON WAIVING <br /> THE LOWER INCOME HOUSING FEE FOR MERCEDES BENZ ON PLEASANTON <br /> (PUD-81-30-/PUD-85-08) <br /> WHEREAS, Chapter 17.40 of the Pleasanton Municipal Code establishes a Lower <br /> Income Housing Fee; and <br /> WHEREAS, Chapter 17.40 also includes guidelines for fee exemptions and reductions; <br /> and <br /> WHEREAS, due to a unique situation that the Mercedes-Benz of Pleasanton expansion <br /> project will result in significantly fewer employees than occupied the site previously, it is eligible <br /> for consideration of a fee reduction or waiver. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> Section 1: The Lower Income Housing Fee estimated at $172,962 for the Mercedes- <br /> Benz of Pleasanton expansion project (PUD-81-30/PUD-85-08 is hereby waived. <br /> Section 2: This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on September 4, 2012. <br /> I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the foregoing <br /> resolution was adopted by the City Council at a regular meeting held on the 19th day of June, <br /> 2012, by the following vote: <br /> Ayes: <br /> Noes: <br /> Absent: <br /> Abstain: <br /> Karen Diaz, City Clerk <br /> APPROVED AS TO FORM: <br /> Jonathan P.
